If anyone is clue'd up on the CPA and could give me some guidance it would be truly appreciated.

My situation is this,

I bought NFS the Run (PC version) on Saturday 28/11/2011. I have installed it and played it on and off untill today.
I personally think this game is a load of rubbish and wish to return it. The retailer will not take back the product, due to the installation "key" being bound to my online account with EA.

So i called EA's helpdesk and they quoted me the EULA (end user license ageement), which basically says they will not take back any game that has the orginal installation key bound to any user account.

Now if i'm not mistaken don't have 7 days (according to the CPA) to return a product i am not satisfied with ?

If EA doesn't have means of dis-associating the key from my account, i fail to see how this negates any form of a return policy ?

Anywhoo, i am going to lodge a complaint with the NCCSA. I don't understand why a customer should be stuck with a product they are not happy with ?
 
Why didn't you download the demo?

I don't think "Not happy with" is a valid reason to return the item under the CPA.
 
why didn't you download a demo first? It's like buying a DVD, watching it, saying the movie sucks and wanting to return it.
 
well not playing a demo is a fault on my part.

I currently own all of the NFS titles and I am more than a happy camper with them, so i didnt feel that playing a demo of the latest release was necessary.

Nevertheless I still fail to understand how this "key" issue negates a return policy ?

Doesn't the key allow you to have a digital download? In that case it makes sense for them not to allow you to return the game since you can get your money back and then just download the game from EA since it's linked to your user account.

Use the product code from your box or manual to activate a digital download of your PC game. Available for the latest PC games from EA, this gives you an option, if you ever lose or misplace your disk, to reinstall your game using EA Download Manager. Activating your product code will give you additional features such as up-to-date game patches and additional bonus content for the latest EA games. (example: A1B2-C3D4-E5F6-G7H8 or A1B2C3D4E5F6G7H8)

Well this is my point Xrapidx.

If the key is used, its tough titty for you as a customer (according to EA). You can not return the product to the retailer or resell the product as second hand.

So my point is, once the key is used there is no form of return policy that a customer can utilise to return the product or pass on to someone else who would enjoy the product.

No it doesn't make sense.

Simply put, if EA did not make a provision to unassociate the key from my account, i fail to see why this is made my problem due to their lack of forsight or maybe it's just to protect their revenue. Which again shouldn't be my problem.

CPA is for the return or handling of defective products. The game runs, installs and you've played it over the weekend. That is not grounds for invoking the CPA.

Under the new CPA ACT.The supplier may refuse to refund you if the product is not deffective.

You will not be refunded because of dissatisfaction of the product
 
this weekend i am going to buy a Ferrari and take it back after a few days cause i think it is carp :p

Completely as posted above..

Your dissatisfaction with the product is your own problem, not the retailers or the suppliers... The product is not defective, therefore suck it up and chalk it up to experience.

Next time you wish to invoke the CPA improperly, I hope I'm the retailer you do it to so that I can kick you out of my shop.

I still don't get the point? You want to return something because you're "not happy with it" when there was an opportunity to test it before buying it.

I fail to see how this is their problem? You could have tested (demo) it, you chose not to, your problem.

Then why i can't have the choice to simply give the game to someone else ?

because it is linked to your profile as stipulated by their EULA or whatever, which may i add you must have selected " I agree" to :|
