Debt Question

Yo,

I do get you on this one, I am married in COP (3yrs now) but why can I do the following without my wife?

*Bought her a car for her B-DAY on my name, which she had no knowledge of (no signature was needed from her, car is in my name tho)

Yea - someone did something wrong.

I worked at ABSA vehicle finance and it was the exact same case ; guy phoned me to buy a car for his wife secretly - but we couldn't because they married in COP

I have a question, and I am hoping the knowledgeable folk her on MyBB will be able to assist.

I am getting married in a couple weeks, but I have some adverse debt on my hands, if I get married COP will this affect my soon to be wife's credit record?

You must have the worst lawyer in the world to NOT advise you against getting married COP...
 
Will the ANC with accrual mean my debt wont be hers at all, I really dont want her to have to pay my debt in anyway, shape or form.

I was in the same boat: Go ANC but get life insurance to cover your debt and them some more.

Going ANC makes life easier, two weeks ago I bought a car on HP and did not require my wife to sign even though I thought she had to.
 
What nonsense are you guys talking about co-signing things??? I bought my house, and I'm now on my fourth vehicle. Never has the bank asked me to get my wife to sign and I'm married in community of property.

Hell just two weeks ago my wife went to open a clothing account and if I didn't see the card I would have had no knowledge about it.

How does it work?

Both spouses share equally in the assets and liabilities.
Spouses have equal powers of administration and (except for some exceptions) both can act independently.
Written consent of both is required for certain important transactions such as those relating to fixed property, suretyship and credit agreements.
Informal consent of both is required for transactions such as the selling of goods of the joint household, such as furniture.
Consent is not a requirement for transactions relating to trade, business or profession of the spouses.
The Act provides for the protection of the spouses should one act to the prejudice of the other.
Your house and cars have been bought fraudulently, and the clothing account was also opened fraudulently...

you got the debt before you got married so with that contract ..... aslong as you don't make more bad debt it won't be hers....

Go tell that to the banks and clothing stores who we all know abide by the law :D

I'm thinking back now and I bought my house just before we were married, which explains why she didn't need to sign, but the cars hayibo!
