Drivers locked up

Anyone seen how well emergency lane abuse was enforced by Gauteng Traffic on the Ben Schoeman (before Olifantsfontein) this morning? This is how it should be done. Message on electronic sign warning motorists and then cops standing under the sign pulling offenders off that ignored the warning. Good stuff!
 
Exactly! There's no point in arresting a couple of arbitrary offenders in one small area for one day, and the very next day go back to watching taxis and the like belt down the emergency lane at 200 and do nothing
Agreed. They should arrest everyone every day. But seeing as the prosecutors couldn't be bothered backing up the cops (as is so often the case), I think we will go back to the status quo. Do what thou wilt shall be the whole of the Traffic law.
 
Well, next time someone tries to steal my car I'm gonna phone the cops and say theres someone outside talking on their cellphone and not wearing their seatbelt! record response time
 
i have a question though... say they take you to prison for one of these minor crimes.

You get Raped while in custody, and contract AIDS, surely you could sue them for millions upon millions.

Er no. They were not thrown out of court. The prosecutors didn't feel that it was worth their time or effort in taking them to court. Big difference.

Public prosecutors threw out the cases against 17 minor traffic offenders that had been placed on the roll in Randburg and the same happened in Roodepoort, where there were six cases on the roll.

If you say so. More likely News24 reporters need to brush up on the accuracy of what they print. The cases never went to court. Hence they were not thrown out of court. The implication of being thrown out of court is that there was no case to answer. i.e no evidence of a crime being committed etc. Prosecutors declinging to prosecute is something else entirely.

And if they decide to not prosecute because they think there is no case? Is that (more or less) the same as being thrown out, without actually being in the court itself?

Same result but I think the difference is for it to be thrown out of court it has to be thrown out by a judge/magistrate.

Ok. So it was thrown out, but not out of court, just scrapped from the roll, so to speak (if the term is correct)?

I don't think it was ever put on the roll as such, think that only happens once prosecutors decide to prosecute, but I'm not totally sure myself.
 
This is the uniform of the JMPD:blue shirts, brown trousers, black leather boots and baseball caps sporting a JMPD badge.

Interestingly, if the officer is not in uniform you are not compelled to stop. This includes the hat. Your decision on how you'll use this - no hat, just drive on. Of course they'll make a huge noise about failing to obey instructions etc. etc. and off you'll go to court. You'll still end up with the talking on cell phone fine (or whatever your offence was) but the rest will be thrown out.

I, as a matter of principle ask anyone who asks me for my driver's license to show me their id document. Just smile and ask for it - it usually means that they have to go get it from their car or whatever.

This may sound silly or childish but in as much as they want me to behave responsibly on a road by being draconian, I want them to act like grown ups too and comply with the laws and regulations. Can you imagine if we had some drunken person who had just crashed into a crowd of school kids get off on a technicality because the person executing an arrest wasn't entitled to do so because they didn't have a cap on their bonce

There is nothing here refering to the way the arresting officer is dressed, however failing to pullover for a unmarked vechile or a officer in civies is understandable in todays climate. However in that case I would suggest you hightale it to the nearest marked police vechile or station and tell them your story.

Holding cell, not prison. They are two very different things. And they don't lock you up with hardened criminals. Whoever is with you in the cell can't really do much because the officers stand right outside the cell.
