Estate Agent won't return deposit

I'm supposed to meet with our estate agent tonight to hand over the keys to our old flat.

The deposit seems to have vanished though. No one knows what happened to it and now she won't return our deposit.

Can I refuse to give back the keys in this case?

What counts in my favour and what counts against me?
 
Has it vanished (which would make it illegal)? Or are they simply withholding it? You appear to be suggesting it has both vanished and they're withholding it - all very magical.
 
They have 7 days to give it back usually, you can try the rental courts. Just have to go through the mission of that, but worth because screw them.

The original deposit has vanished. Now they won't give it to us because they don't have it.

If that makes sense to you.
 
You need to get hold of the Housing Tribunal at your municipality....-get ready to fill in **** load of documents...took a bit for them to get to my case, but when they did....only took one visit from them, and my deposit was refunded ...
 
If I were you, do not give back the keys until you get the deposit. Assuming you have not damaged the place.
 
LOL vanished? I would have sworn at the agent if she told me that my deposit 'vanished'.
Keep the keys until it is makes its appearance again...
 
I'm not understanding, are they saying they don't have enough money to pay you back? Or are they saying that you never paid a deposit? What exactly are they meaning by money "vanished" ? I mean it's not your problem that they "misplaced" the money, they still owe you money.

I can't just tell the bank "oops, i can't pay my bond this month, the money vanished" , i will still owe the bank the money....

I was hoping to keep it as short and sweet as possible. Something along the lines of the person responsible for holding the deposit( on behalf of the agent) vanishing along with the money and now it's our responsibility instead of the estate agent.
 
There are no damages.

Ok let me try again. When it's looking like you definitely won't be getting your deposit back, cause damages to the place that are equivalent to the deposit. Got it?
