They're not trying to pass it as the real thing. They explicitly state it's a recreation. Maybe done under licence

That's generally true.

There's apparently been many lawsuits regarding the legality of replica cars and it's still a bit of a grey area but there is no debate that they may not be sold with the original manufacturers trademarks and emblems, unless authorised to do so or if those trademarks are in the public domain as with some very old and now defunct car manufacturers.

Ferrari trademarks and emblems aren't in the public domain and neither is the car in the op an authorised copy

Ferrari doesn't let anyone make licensed replicas of their vehicles and for arguments sake if that had been the case then the ad would have made that point loud and clear because it would add significant value.

So if I buy a genuine Ferrari bonnet complete with logo and put it on my fibre glass car replica? Same with buying a new Ferrari, ripping off the bodywork, fitting a complete new carbon fibre body kit and upgraded head and then still calling it a Ferrari ... it’s why these cases usually fall flat unless someone is making a commercial entity to manufacture replicas for the mass market.

Don't tell me tell the judge, perhaps you could do many of those things with your personal belongings but reselling them like that is where it becomes problematic.

Apply common sense, just because a manufacturer puts a genuine logo or part on your replica isn't going to suddenly make that item exempt from the legalities of trademarks, nevermind putting a trademarked logo on an item shows intent that you are in fact trying to make an unlicensed copy.

The op mentioned the guy made 8 of them so there's no dispute that they are being manufactured on a commercial basis.

They aren't licensed replicas though, Ferrari doesn't allow anyone to produce replicas with Ferrari trademarks on them.

The link you posted is to a company doing replicas the legal way, I couldn't see a single mention of Ferrari or their logos anywhere on the website or the cars themselves.

However, the one car in the background is parked on the right of the road, which could mean it's right hand traffic. Also not a vehicle brand I recognise. Could be a Skoda Fabia?

Anyhow, first pic, the number plate of the Ferrari is visible. It reflects off the chrome bumper. Def a UK plate.

Hi Airborne! Okay, I had a great laugh after finding this when I googled my phone number! You are clearly an American, because only an American can be so stupid! Let me tell you the full story, as you clearly have super Low-IQ, so can't comprehend or figure much out correctly from my original advert. I retailed cars for private customers for many years, and this car I was advertising for a private client that actually built this car, and the other 7 I mentioned. He built it in the UK, and even a certain Top Gear and Grand Tour cast member bought one of the other 7x 250 SWB Spider "Recreations" in the UK, from him, and yes, he paid just as much as what I was advertising this one for! Ever hear of Ferris Bueller's Day Off??? Well, for that movie, they built 3 replicas, the "Hero Car" has been auctioned off a few times over the years, for crazy money, a lot more than R2M! The other 2 cars built, one was naturally damaged in the crash scene in the movie and was then ordered to be destroyed, along with the 33rd and final replica. Guess what, the 3rd car was never destroyed and my client managed to buy it and then made a mould from it, which he then used to recreate his 8 cars from! All starting to make sense now, or are you still too American to comprehend this detailed explanation? As for the Donor Cars he used, he used the BMW Z3 for each of his 8 Recreations. All Visible Parts, means the parts you can see on the outside of the car and the dials and stuff you see in the cabin, meaning that the chassis is BMW, Not Ferrari! The ENgine is BMW, Not Ferrari! The wires and pipes and stuff are Not Ferrari! Simple enough for you to understand now?? Even Chatgpt is more readable than this. Probably some guy rage typing because he's upset his fake ferrari from/in the UK is associated along with his phone number and thus upset about it for whatever reason? The reg of the vehicle from pics of it on Flickr show it to be a BMW Z3 reg - no export marker though.
