I think we can accept that MWeb would not have a problem if you use a download manager for "unattended" activity while you make dinner or answer the 'phone or whatever.

On the shaped accounts, they do have a problem if you CONSTANTLY download at LINE SPEED 24/7. THAT is the "unattended" activity they are referring to. We've discussed this issue already.

the only reason you would get booted is if you use a eternal service to download and you then use a connection to that that bypasses the shaping

eh? But then ill only be able to do 50GB? A lot of my stuff is downloaded while I sleep (I intitiate before I go to bed) - the problem is that its so slow anyway that it is only 20% done in teh morning, so I leave it on. If MWEB were not to shape me so much my downloads WOULDNT be on 24/7. Last month there was a week when I was downloading nothing - why? Well because the line wasnt so *** slow!

Check the forum - unfortunatetly there are WAY to many MWEB threads - I think its the Unofficial Q&A one.

MWEB denied it, I provided links to hellopeter and facebook - they then did a 180 degree turn and said it will be done if you leave your computer downloading unattended, even when not bypassing shaping.

Their response on facebook to someone who wanted to download stuff only nightly was that it was also not allowed...as per the T&C

Constant downloading of anything which is shaped is probably (?) considered acceptable (even though the downloads are unattended) because the shapers will restrict the download.

Constant (HTTP) downloading at line speed is not acceptable on the shaped accounts AFAIK. I think the issue here is "CONSTANT". If you max out your shaped account at line speed 24/7, you are in contravention of the T&C, as this type of heavy usage is not appropriate for the shaped product.

I think this is the case
I have yet to see someone doing HTTP downloads where they get 200+GB without it them pulling it from some weird source

thus bypassing the shaping put in place

if you have constant torrents running you can do over 400GB PM (In fact a buddy of mine does it) and not get a call
(at least he hasn't yet received a call)

As always, someones interpretation of MWEBs T&C - I wonder how many people will take responsibility for saying its ok as long as its shaped (even though its still against the T&C).

MWEB have stated on facebook that even downloading unattended just in the evenings is in violation of their AUP.

No shaping, exactly. Which therefore is considered bypassing the shaping. Which therefore means you run the risk of contravening the T&C if you pull down hundreds of GB monthly over encrypted tunnels on a shaped account.

yes that is true but that is also the point the other guys are making.
it is not shaped so it can be seen as bypassing the shaping which is primarily what is getting people banned

as one of the people who got the banhammer call and email, I can guarantee you, they will eventually take action against you if you use the SSL shaping circumvention

It is easy to download via HTTP from unshaped sources. You don't need to run a VPN/tunnel. You find the stuff you need on an FTP or HTTP site or you use a lesser known host. Easy-peasy.

Last night from about 2:00 till 7:00am downloads from regular one click hosts were running at 440KB/sec.
Downloads from one click hosts run at about 200KB/sec from 11pm to 2am.
Downloads from one click hosts run at about 130KB/sec from about 8pm to 11pm.
The speed before that is about 40-60KB/sec.

Lesser known free hosts, pay or ad supported proprietary file hosts eg adult sites or foreign TV networks run unshaped at all times.

So it is easy to do >400MB/mo and quite possibly 1000GB/mo not bypassing shapers.
 
exactly my point Chainedfly if you bypass the shaping you will get banned
SSL downloads bypasses the shaping
