Fine for 'not moving over' squashed

The judge ruled that the cop abused his authority. I don't understand how that follows from either of your scenarios.

Also, I remember from what the guy said in all the interviews beforehand - he saw the car, was aware it wanted to pass, but decided not to allow it as he was already at or exceeding 120.

My point was that if the person (1st car) was not aware of the 2nd cars intentions then it is absurd to fine them.

If that's the case (I haven't followed this story, just read this article) then he was contravening the regulations.

Whether he was aware or not, he should have been on the left, unless he was overtaking, which he obviously wasn't.

Heh, if you're not aware of a car behind you, especially if it's flashing headlights at you, I submit you're guilty of negligent driving or driving without due care and attention ;)
 
I read in another report on the matter that the guilty party states , that it proves he is allowed to do 120 in that lane and not pull to the left for whatever reason. The defense was therefore not that it was unsafe to do so, or impossible.

...sounds like just one more inconsiderate , self-important GIT that doesn't understand that the 120km/h indicated on the speedo of his blik is in reality only around 108km/h

By his own admission that he saw the car, and would have given way to an emergency vehicle. i.e. he admitted to deliberately hogging the lane.

Whats amazing is that if this cop was in such a hurry to get somewhere important like a robbery etc etc is that he had the time then to stop the motorist and give him a fine.

I saw a cop t-bone a car with a family inside because he jumped a red robot at speed with just his blue lights on. The other guy struggled to see him because the cop blasted through in the middle of 3 lanes and it was dusk with the sun out, no sirens on, hell I only saw the cop car because I was on the far side of the road crossing and I had a wider field of vision due to my distance. Once I got out my car to assist I asked the cop where he is going at that speed and why his siren was off, his reponse was "I'm going to the station because someone stole some metal"... this was like 5:30pm, I'm sure this guy was just going home and wanted to rush, if some metal was stolen AT THE POLICE STATION i'm sure there are enough cops around to assist. I took a video of the conversation in case this still ends up in court. Cop was a **** and the car he hit had 3 children in the back, he hit the back panel missing the door by centimeters.

Completely irrelevant.
The law is clearcut. You have to move over. Doesn't matter what kind of vehicle it is, or in how much of a hurry they are.
 
I would be very interested to see what happens if a cop vehicle was in the right-hand lane doing 120 and a private vehicle came up behind him and flashed his lights.....

I know that is the law, I'm not disputing that part. If safe move over, we don't know if it was safe or not.

He admitting as much as hogging the lane for no other reason other than the police car not having it's blue lights on. Only then, he says, would he have moved over.

bull****. The cop was being abusive. End of story. He could have backed off and flashed the guy, signalling that he wants to overtake. I ****ing HATE people who ride on my ass in the right lane when I'm already going 130...

You should be doing 130 on the left, as the law requires, unless you're overtaking. God, did some of you people buy your learner's license?
 
If I have to speed up in order to get in front of the guy on the left so I can pull over left to allow some hotshot to pass me - and I go through a speed camera - is the hotshot going to pay ?
