You didn't consider taking any legal action? If they expected me to pay even R5 for anything involved with the doctor's mistake, I would take legal action out of principle. The patient shouldn't have to pay a cent because of a doctor's incompetence/negligence.
Bear in mind that doctors are bound by the terms and conditions of their malpractice insurance policies, which prohibit the doctor from acknowledging wrongdoing. Doctors cannot simply pay the hospital fees of their patients, as this can be construed as an admission of guilt.

From a legal standpoint you're looking at gross negligence and a complaint to the HPCSA along with a visit to a lawyer specialising in the medical field will certainly sort out any issues you may have.

yeah seek legal council and make sure you take it up with the hospital management and the surgeon in question. They must perform the surgery to remove it free of charge as its their negligence that has put the patient in this scenario
First talk to them yourself before lawyering up maybe you can avoid legal charges but make sure everything is on signed documents and not verbal agreements

Sorry about your experience. At law you are able to fully recover your loss. Don't be fobbed off. Take action. Learn from the Importunate Widow.
In this case, however, the other necessary therapy cannot proceed until the forceps are removed, which puts pressure on the grossly negligent medico to cough up no matter what his insurance says. Negotiate privately and insistently - in many cases these issues are resolved without involving insurance companies and lawyers. Don't just roll over.

You do not have to buy anything! Are you a medical ekspert of sorts? I have surgical steel wire holding my back together since I was 18 and that foreign object caused no problems whatsoever.
Ever heard of steel plates protecting the brain or mending bones ?

The forceps turned out to be a pair of surgical scissors. They were removed in the past week and now the couple involved will be or have had their first meeting with a legal firm. The operation to remove the object was conducted in the same hospital as the original operation. The X-rays of the patient together with the object itself were attached by senior management in order to conduct an "enquiry".
The danger to the lady might have come if she had had radiation therapy with the scissors still in her body cavity.

no i'm not an "ekspert". but your situation is not the same as having a pair of surgical scissors or forceps left inside the abdomen of a person. and i'm still not buying this story. just go google the many cases of these where these objects were left behind by mistake and the amount of pain these patients suffered before these objects were discovered.

you can be as sarcastic as much as you want, but this whole story is a load of tosh. going a year without any pain is not going down in my books. i don't care what anyone here says. you all seem to think having a pair of surgical scissors in one's abdomen is normal without feeling any pain is the norm. sorry you are so wrong. you lot aren't even bothered to google the many horror stories out there of these things that happen.
Celine it was never claimed that there were no ill effects from having the surgical instrument left in her lower abdomen, there were. But having a colostomy and going directly into an extended bout of chemotherapy she believed that the discomfort felt was as a result of using a bag and having the medical treatments. It was only after the chemo that questions were asked. Doctors and other medical staff who could have found the problem were away for holidays and only when preparing her for radiation were the answers forthcoming. I will say no more at this stage as investigations, legal actions and complaints to medical bodies are all either in progress or being prepared. Your being skeptical is understood. I was looking for ideas to help me support someone whose family is very close to me.
