Need some advice. My brother has been out of a job for 6 months and he has kids, so needed a job urgently.

He went to an agency and they sent him to Chicken Licken, in Durban.

They made him an offer, but it is ridiculous! He needs the income, but not sure if anything can be done! I guess it is take it or leave it, but surely there are Labour Laws to take in to consideration?

Firstly, the salary is pathetic - R3500 pm! That as the Manager of the branch. Secondly, he gets one day off per week. He works 3 days 8am - 5pm. Two days 8am - 10pm. One day 8am - 11pm. And to top it all off, he gets 10 minutes lunch break?

Then the owner tells him he has to buy his own uniform and safety boots!

I told him not to take it. But we're just concerned that these franchises gets away with shoddy treatment of the staff! And they know that loads of people are looking for work.

So do we just leave it or take report it to the Dept of Labour?
 
AFAIK the minimum lunch break is 30minutes? That is the only issue I see there.
 
If he goes he can report the owner and will still be out of a job.
There's no way that tw@t will employ him.

Best is to sit down with owner and discuss basic conditions of employement,which every business should have posted on the wall.

If owner doesn't budge then he should not take the job and then report him.

R3.5K is better than nothing.

In the meantime he should keep looking.
 
On the Dept of labour website, it says max amount of hours allowed per week is 45. He will be working 70 hours per week. That without being paid overtime and that without his lunch breaks being increased.
 
I'd imagine he'd first have to have the job before could report them
 
Don't think he will take it. There are a few other options that is coming up (call centre for instance, with basic of R3000 + commission). But what troubles me is that these owners gets away with this!
 
From the Basic Conditions of Employment.

Meal intervals
14. (1) An employer must give an employee who works continuously for more than
five hours a meal interval of at least one continuous hour.
(2) During a meal interval the employee may be required or permitted to perform only
duties that cannot be left unattended and cannot be performed by another employee.
(3) An employee must be remunerated—
(a) for a meal interval in which the employee is required to work or is required to
be available for work; and
(b) for any portion of a meal interval that is in excess of 75 minutes, unless the
employee lives on the premises at which the workplace is situated.
(4) For the purposes of subsection (1), work is continuous unless it is interrupted by
an interval of at least 60 minutes.
(5) An agreement in writing may—
(a) reduce the meal interval to not less than 30 minutes;
(b) dispense with a meal interval for an employee who works fewer than six hours
on a day.

Overtime is only paid if you don't earn in excess of a certain amount. I wish I got overtime :(

You're at all not aware of your labour rights? You're trying to get advise on suchlike wrt to Chicken Licken employment issue at my MyBB? Interesting....
