What does the consumer act say? Am I allowed to keep the second item or does the company have the right to demand it back? Both items are identical and both delivery notes have my address and name on it. I was only charged for the one item.

What does your conscience say?

Obviously it's saying "Oh noes, what should I do, maybe I should give it back"

Otherwise why post on a forum? To brag? Don't think so.

If it bothers you, phone the company and ask. If they say keep it, keep it. I had the fortunate situations before and each time they just let me keep the item and said it was their mistake and not to worry about it. But this was quite a while ago when there wasn't so many douchenozzles walking around

I'd suggest phone them and ask them how to proceed as envo said. Personally I'd be reluctant to pay or make significant effort to fix it though...i.e. if they want to send a courier to fetch it cool...but I'm not shipping it back at my own cost/time.

Well what is the item firstly?
Does it matter?

“Churchill: "Madam, would you sleep with me for five million pounds?" Socialite: "My goodness, Mr. Churchill... Well, I suppose... we would have to discuss terms, of course... "
Churchill: "Would you sleep with me for five pounds?"
Socialite: "Mr. Churchill, what kind of woman do you think I am?!" Churchill: "Madam, we've already established that. Now we are haggling about the price”

Depends which company. Happened to me with Kalahari (naspers), naturally it doesn't even come close to what Multichoice (naspers) owes me, so I take it as 1 percent of the restitution due to me from Multichoice. They even picked it up in weight tracking and called me.

razer1980, I'm sure you already know what the best course of action is: Call or email the management and let them know what happened. It's up to them to decide and initiate the next step. If they want it back you should not be put to any avoidable trouble or further expense. This means they should collect it rather than asking you to take it to the post office or a courier.

There is not a person on earth who doesn't make mistakes, so not a single one of us can mount a high moral horse and claim title to the fruits of another's innocent mistake.

It matters not a jot whether the supplier is small or large, rich or poor, terrestrial or alien.

The moral decision is yours to make. Treat others as you would have them treat you. As you weigh, so will you be weighed. This is a test of your character, not theirs.

Follow your informed conscience, do the right thing, and let them know.

If you ignore the technicalities of consumer act and return extra item to company, you will feel good.

Dumb post. "What does the consumer act say", as if you want to argue with them should they want to collect the extra item? LOL

Goods remain the property of the respective reseller /suppliers /distributors until paid for in full. Those are the common terms used by reseller /suppliers/distro etc.

Look they might never ask for it back, but if they do within 2 years then you have to give it back or pay for it. It would constitute theft otherwise. If after 2 years they have not asked for it back then they have no claim since the debt would be written off.

*the law says debt is written off after 2 years or 3 years? I think it's 2 now?

well said. to many people in the world don't follow an honest heart.

The right thing to do would be to contact them and send it back. Someones job might be on the line. I would personally send it back.

From my experience when a company messes up like that, I email them and most of the time they will just tell you to keep it.

If your domestic, gardener, plumber (who worked for you for years and been loyal) had received a double payment from you, would you want them to tell you? Or keep it and say tough luck for you?

I would guess in that case you would want to be told about the mistake so that you can make a decision on whether you want to reward the honesty or not. But then it's YOUR choice.

Call them. Tell them about the error.

Why should he send it back and incur postage or courier costs for their mistake?

Tell them that they can come and collect it (or send their courier company). Unless it's a high end item, chances are they'll write it off and tell him to keep it.
