We're not strictly enforcing the capping policy yet, but are calling those who greatly exceed their cap at this stage, and slowing down their connection. This will soon become an automated system with automatic email warning alerts.
I want to make things quite clear to GWI as I did in my letter of reply to the bulk mail.
You will *NOT* unilaterally change the terms and conditions of our contract. This is for a 128k, uncapped Internet service. Based on this advertised service and verbal confirmation from your marketing manager, Grant Tyson, I signed up and spent about R2 500 on equipment.
If you wish to renegotiate a *new* contract with me and with other subscribers, then feel free to do so. But what what I want is something *definite*, not a letter that may or may not be 100% accurate, perhaps could have been better phrased, not a pricing that may or may not change, and certainly not semi-formal communications from a web forum. Something definite, in writing and addressed to me personally.
Based on this I may wish to enter into a new contract with GWI, which I will do in the form of a signed contract. Should I choose not to enter into a new contract, you or I may give one calendar month's written notice. The way I see it, these are your two options. To turn around and say "oops" 12 months after you willingly entered into such a contract is just tough. Willing buyer - willing seller and no one twisted your arm.
Should the contract be terminated, please also advise what pro rate refund you will be prepared to provide in terms of Point 6 of the terms and conditions of our contract.
Now, I'm not going to threaten you with legal action because that's ridiculous. But if you want to damage your reputation, go ahead.
