Terror-accused Thulsie twins to pay police minister's legal bill

Johannesburg – The South Gauteng High Court in Johannesburg on Tuesday ordered terror-accused twins, Brandon-Lee and Tony-Lee Thulsie, to foot a Minister of Police legal bill, after they abandoned their application for access to police documents they needed to prepare their defence.

The brothers were arrested during raids in Newclare and Azaadville, on the West Rand, in July 2016.

They were allegedly linked to the self-proclaimed Islamic State (ISIS) group and were allegedly planning to detonate explosives at a US embassy and Jewish institutions in South Africa, according to the charge sheet.

The twins, who were previously represented by attorney Annelene van den Heever, have also appointed a new legal representative, advocate Saleem Khan.

At a previous court appearance, the brothers were provided with access to the docket, which contains information about the State's case against them, so that they can prepare their defence.

However, they later lodged an application requesting access to additional documents, which did not form part of the docket. They also asked to consult with State witnesses.

Wasted costs

The additional documents were in the hands of the South African Police Service only.

The Minister of Police therefore had to be joined to the proceedings in order to oppose the application.

But the twins later abandoned the application, after they were informed that they had not made out a case for the relief they sought.

On Tuesday, Judge Raylene Keightley ordered them to pay the wasted costs incurred by the minister.

Keightley said the police complied with all the rules and said there was never an undertaking from the applicants that they would not proceed.

"It is only just and equitable that the party that seeks the withdrawal of the application in these circumstances, should be ordered to pay the wasted cost to the Minister of Police," Keightley said.

In the indictment, submitted to the court in April 2017, the State lists 12 activities the twins were allegedly instructed to carry out, using firearms, explosives and possibly poison.

Terrorist plans

It stated: "In August 2015 [Tony-Lee] became a participant in a series of Telegram chats with Abu Fidaa, an ISIS network, and other persons whose real identities are unknown to the State, during which he was instructed to:
• attack the best targets involving 'US/Brit/French interest in SA';
• kill Zapiro, who drew the Messenger of Allah cartoon;
• kill Jews who fight in Israel and return to South Africa;
• kill affluent Jews; and
• kill a gay imam 'as yet unidentified'.

Other targets included King David High School in Linksfield, Johannesburg, the UK High Commission, the US and Russian embassies, the first secretary to the French mission, Jewish investment banker Roy Topol, SA Zionist Federation Telfed, state-owned arms manufacturer Denel, Jewish community events and foreign interests at airports.

It is alleged that Tony-Lee discussed terrorist plans with an undercover US Federal Bureau of Investigation (FBI) agent between May and June 2016. He believed the agent was an ISIS operative, based in the US.

He allegedly sought advice about making bombs and asked for funding and is accused of soliciting support for ISIS, using his personal Facebook page.

Brandon-Lee allegedly acquired the Mujahideen Poisons Handbook by Abdel-Aziz, and the manual How to Survive in the West: A Mujahid Guide, which teaches readers how to "live a double life" and "how to keep your secret life private".

The case was postponed to April 16.

Woman arrested with Thulsie twins now faces kidnapping and other charges in KZN

Johannesburg – A woman previously arrested with the terror accused twins Brandon-Lee and Tony-Lee Thulsie is now facing kidnapping and other charges in KwaZulu-Natal.

This comes after a Cape Town couple disappeared near the Bivane Dam in Vryheid, KwaZulu-Natal, on February 12.

Fatima Patel, 27, and Sayfydeen Aslam Del Vecchio, 38, were identified as possible suspects on February 16.

Hawks spokesperson Captain Lloyd Ramovha said they appeared in the Vryheid Magistrate's Court on Monday.

They are charged with kidnapping, robbery and the possible contravention of the Protection of Constitutional Democracy Against Terrorist and Related Activities Act.

Ramovha said the duo also faced a charge of arson for allegedly torching and destroying several hectares of sugar cane fields in 2017.

Thulsie case postponed

The sugar cane fields at the Huletts plantations were valued at R2m.

He said the National Prosecuting Authority's priority crime litigation unit was helping with the prosecution.

The case was postponed to March 1 for a formal bail application.

Patel and her brother Ebrahim Patel were previously arrested at their home in Azaadville in 2016 during police raids on the West Rand that also led to the arrest of the Thulsie twins.

The siblings appeared in court at the time on charges of possession of unlicensed ammunition and explosives.

They were released on R5 000 bail.

Meanwhile, the pre-trial hearing of the Thulsie twins was postponed to April 16 in the South Gauteng High Court on Tuesday.

They were kept in custody.

Thulsie twins' case postponed again


JOHANNESBURG - The case against the Thulsie twins, who were arrested on terror related charges, has been postponed once again.

Brandon-Lee and Tony-Lee Thulsie were arrested almost two years ago after being accused of planning attacks on Jewish and American interests in South Africa.

Thulsie twins terror trial delayed yet again by countries sitting on evidence

One of the twins was allegedly instructed by an ISIS terrorist network to attack US/British/French interests in SA and kill cartoonist Zapiro, among others.

The Johannesburg High Court heard on Wednesday that the trial of terror accused twins Brandon-Lee and Tony-Lee Thulsie was still not ready to proceed.

State prosecutor Chris MacAdam said that evidence from foreign countries was still outstanding.

The Thulsie twins were arrested and put behind bars in July 2016, and have been charged with conspiracy, incitement to commit the crime of terrorism and conspiring and attempting to commit acts associated with terrorist activities.

The duo stood in the dock in black Muslim clothing.

“We have to get to a point where we say, no more delays,” MacAdam said.

The identical twins were back in the South Gauteng High Court in Johannesburg on Thursday morning where the matter was postponed yet again. They appeared briefly before Judge Raylene Keightley where she said that the matter would be postponed to allow the pre-trial process to continue. Johannesburg - It would cost the State about R77 000 to print out documents detailing its entire evidence against the terrorism-accused Thulsie twins.
The South Gauteng High Court, Joburg, heard on Wednesday that the defence team for Brandon-Lee and Tony-Lee Thulsie was now seeking hard copies of the documents the State had obtained for its case.

Adele Barnard, the State’s prosecutor, told the court the defence team had raised issues about the digital material they had been given.

“Although previously we agreed that copies, due to the volume of the evidence, would be given to them in a digital form, the defence indicated this morning (Wednesday) that they now require that all the documents be printed in hard copy for purposes of consultation,” said Barnard.

“Now, I indicated that the previous quotation the State obtained - and that was while still in the regional court for bail application proceedings - amounted to around R77 000.
“I explained that I need to follow due process if they persist that the State must give them that evidence (in hard copy),” Barnard said.
Wednesday's proceedings before Judge Raylene Keightley made it apparent that the Thulsie twins’ trial was far from beginning.

Thulsie ‘terror’ twins to launch fresh bid for bail

They were charged under the Protection of Constitutional Democracy Against Terrorist and Related Activities Act. Lawyers for terror-accused twin brothers Brandon-Lee and Tony-Lee Thulsie have bemoaned the lack of “proper and adequate medical care” at Pretoria’s Kgosi Mampuru II Management Area (prison). The twins are now in their fourth year behind bars awaiting trial. The case came briefly before the High Court in Johannesburg yesterday, with a fresh bid for bail looming. Despite earlier abandoning bail, the Thulsies’ legal team is now preparing to argue that it be granted. The new application came before Maletsatsi Betty Mahalelo last week but was subsequently postponed for outstanding documents to be filed. Meanwhile, yesterday, defence counsel advocate Anneline van den Heever told the court that Tony-Lee had been suffering from dental issues for “a period of months”. Van den Heever said: “Each and every request that he made to see a dentist was not adhered to. “He finally, last week – because he insisted – managed to see a dentist and was told there was nothing that could be done for him and that he would have to have all of his teeth pulled out.

If it was a weak case, they would not be in jail anymore. POCDATARA is not a joke, if you need to be charged under an act, hope it's not POCDATARA. Just ask the Boeremag guys :)

If the state had proper evidence, or if these numbnuts brats was proper terrorists, they would have been under CIA rendition long time ago.
