A hearing into a misconduct complaint against Cape Judge President John Hlophe must go ahead, a tribunal ruled on Thursday.

Tribunal president Judge Joop Labuschagne said the matter should proceed without any further delay.

"The main objection raised on behalf of Judge Bess Nkabinde and Judge Chris Jafta and Judge President Hlophe is dismissed," said Labuschagne.

"This matter should proceed without further delay."

The misconduct complaint against Hlophe was laid in 2008. He allegedly tried to influence Jafta and Nkabinde to make a ruling favouring President Jacob Zuma.

This was while the two Constitutional Court judges were considering a judgment in a corruption case relating to Zuma and arms company Thint involving the multi-billion rand arms deal.

I'm all for due process, fair trials and the like but honestly, some of these things just tie the legal system down.... 5 years since this first started and we still have not started....

Hlophe Tribunal Adjounred

The hearing into the misconduct complaint against Western Cape Judge President John Hlophe has been adjourned to Tuesday.

Judicial Service Commission tribunal president, retired judge Joop Labuschagne, said on Thursday he would be fair to all parties involved.

This was despite Courtenay Griffiths, QC, for Hlophe, arguing that the hearing should continue immediately.

"There ought to be no delay until Tuesday," he said.

"These unsavoury protracted proceedings have gone on for too long, we want to proceed now, we insist on starting now."

The tribunal ruled on Thursday that the misconduct hearing should proceed, despite objections from Constitutional Court judges Chris Jafta and Bess Nkabinde, and Hlophe.

The misconduct complaint was lodged against Hlophe in 2008. He allegedly tried to influence Jafta and Nkabinde to make a ruling favouring President Jacob Zuma.

The two Constitutional Court judges were considering a judgment in the corruption case relating to Zuma and arms company Thint's role in the multi-billion rand arms deal.

ConCourt judges must testify: Lawyer

Constitutional Court judges need to testify at the hearing into the misconduct complaint against Western Cape Judge President John Hlophe, a tribunal heard on Thursday.

"What is directly relevant to the evidence by Justice [Bess] Nkabinde and [Chris] Jafta is what occurred between that letter, when they said they were not complainants, and the letter which they signed saying they were co-complainants, and the position now adopted," Courtenay Griffiths, QC, for Hlophe, said.

"It seems to us that the justices of the Constitutional Court that were present during the discussions, which led to a joint statement, are in a position to give relevant evidence."

Hlophe's legal team wanted Deputy Chief Justice Dikgang Moseneke in particular to attend the hearing.

In 2008, Nkabinde and Jafta, in a joint letter, said they did not want to proceed with a complaint against Hlophe. However, subsequent to that the two were part of a co-complaint lodged collectively by all Constitutional Court judges.

The misconduct complaint was lodged against Hlophe in 2008. He allegedly tried to influence Jafta and Nkabinde to make a ruling favouring President Jacob Zuma. The two judges were considering a judgment in the corruption case relating to Zuma and arms company Thint's role in the multi-billion rand arms deal.

The Judicial Service Commission tribunal ruled on Thursday that the misconduct hearing should proceed, despite objections by Nkabinde, Jafta, and Hlophe.

After the ruling, Griffiths said his client was ready to go ahead with the matter which had been dragging on for five years.

"There ought to be no delay until Tuesday. These unsavoury, protracted proceedings have gone on for too long. We want to proceed now, we insist on starting now."

He accused Moseneke of further delaying the matter by not attending the hearing.

"The learned deputy chief justice has had five years to get his act together," Griffiths said.

He wanted Gilbert Marcus, SC, for the Constitutional Court judges, excluding Jafta and Nkabinde, to provide Hlophe's legal team with a list of witnesses he intended to call and what he intended to call them about. He wanted minutes of meetings held in 2008 between the Constitutional Court judges.

Marcus said his clients were ready to testify.

"Those we represent, if required to testify they will make themselves available to do so without the necessity for a subpoena," he said.

However, he said the evidence was in the hands of evidence leader Xoliswa Khanyile. Khanyile had said she intended subpoenaing Jafta and Nkabinde to testify.

"I have discussed this matter since September 19 with the two counsel representing the two judges... These are the only judges I intend calling. I was even thinking of issuing a subpoena."

Tribunal president, retired judge Joop Labuschagne, adjourned the hearing to Tuesday 10am, saying the adjournment would be fair to all the parties involved.

Ten years later, still no action on Hlophe’s ‘Zuma meddling’ complaint

Accusation that Western Cape Judge President tried to intervene in favour of Jacob Zuma has still not been dealt with.

More than ten years after two judges complained about his conduct, questions about Western Cape Judge President John Mandlakayise Hlophe remain unanswered, as Justice Edwin Cameron noted in his farewell speech.

Hlophe was appointed in 1995 at the age of 36 as the first black judge of the Western Cape High Court Division, and the first judge to join the bench directly from academia. In 2000, he was appointed as the Judge President of the Western Cape High Court Division — one of the youngest people to become head of a court.

In 2008 he was accused of improperly approaching Constitutional Court Justices Bess Nkabinde and Chris Jafta to influence the court’s judgment in several cases relating to then President Jacob Zuma, and French arms company Thint. These cases dealt with the lawfulness of search and seizures of Zuma’s home in relation to arms deal corruption.

Justice Nkabinde and then Acting Justice Jafta were among those who presided in four cases in the Constitutional Court, involving Thint, Zuma and the National Director of Public Prosecutions.

Judge President Hlophe is accused of visiting the chambers of the two judges, without invitation, towards the end of March 2008, after argument in the Zuma/Thint cases had been heard, and of trying to persuade them to decide the cases in a manner favourable to Zuma.

Except he wraps poison and deceit in a vein of truth, a well known tactic. Yes, listen to him, but with a flame retarding hazmat suit.

exactly, you just have to cut through the bull ... another telling vein, was his anger directed at black twitter - post the elections. Essentially, you are quick to get onto social media to complain about "the minority" but don't pitch up and vote .. =. electorally they did not get to where they were projected themselves to be post the election.

...his alignment has always been well known, + the political cover he enjoyed from the alignment ...I get the sense, he was managed by the judiciary , now with no real political cover, opportune time to get rid of him.

n a blistering comeback, Western Cape high court Judge Gayaat Salie-Hlophe has accused Deputy Judge President Patricia Goliath of lying, of wanting to oust Judge President John Hlophe and of racism. On January 15 Goliath laid a complaint of gross misconduct with the Judicial Service Commission (JSC) against Salie-Hlophe and her husband, Judge President John Hlophe. The complaint made a number of allegations against the two judges, including that Salie-Hlophe wielded inordinate power at their court, influencing which judges were allocated to which cases and who was appointed to act as judges.

Goliath also said that she had been sidelined by Hlophe after Salie-Hlophe involved her in a private domestic incident at Hlophe’s house.

'Irresponsible and false' - Hlophe denies claim he wanted to appoint judges favourable to Zuma

The reference to former president Jacob Zuma in his deputy's complaint against him was an "irresponsible and manufactured false allegation made simply to spice up the gravity of the case against me", Western Cape High Court Judge President John Hlophe has charged. In a 100-page affidavit sent to the chairperson of the Judicial Conduct Committee this week, Judge Hlophe said the allocation of the Earthlife Africa case in 2015 was based on the promotion of transformation and diversity. Judge Patricia Goliath had in a complaint to the Judicial Service Commission (JSC) accused Judge Hlophe of wanting judges who were perceived as "favourably disposed" to Zuma to preside over the case. She said Hlophe told her criticism against the former president about the nuclear deal was "unwarranted".
