I know but he's claiming the reason proxy for his investigation and findings of racism within the judiciary in general.

As the complaint came from all the Con Court judges he wont be appealing there :laugh:

I think he was eyeing the top job in the judiciary when Zuma ascended. He unfortunately shot himself in the foot with that conduct and when Zuma came into his power Hlophe was too tainted a consideration for CJ.

He can be suspended by the president, but (like the PP) impeachment by parliament could take a decade:
Doubtless the usual suspects will defend Judge Hlophe even as the logic of the finding makes such a defence totally impossible to mount on any plausible basis. In the meantime, the JSC must surely recommend to the president immediate suspension of Judge Hlophe from judicial office. The process of repairing the damage to the judicial institution caused by this unfortunate saga must now commence.

I think impeachment goes to parliament and the whims of ANC factionalism.

The Tribunal will forward their findings and recommendations back to the JSC, the JSC will then determine if conditions for impeachment are met and forward it on to the national assembly which requires a 2/3 majority vote after which el presidente can remove him.

EDIT: Keep in mind the JSC ignored a previous Tribunal recommending judge Motata be impeached...
