You must be kak lawyer if you're using this precedent considering it relied on the unprotected strike to establish the nature of the offense not to mention the usual hearsay arguments to invalidate a medical certificate that could be negated by simple affidavit or testimony by the medical practitioner.
Clearly you do not posess the cerebral fitness to understand even the direction I help you with, but choose to insult me. More reason for me not to prepare heads of argument for you as it will clearly be beyond your abilities of comprehension.

We say 'do not underestimate your opposition', but I made the mistake of overestimating by audience here.

Hpcsa complaints are lodged online. Mine was unacknowledged in a couple of days, however, they are toothless and useless. Either they protect their stakeholders or believe any crap the drs feed them.

I lodged a complaint obo a client against a dr booking someone off for 'headache' for 5 days in the future.....

They refused to share the drs response nor explain how a dr can foresee someone will have an incapacitating headache in the future.

I implemented other measures to address the matter.

Use other avenues if available, depending on the issue at hand.
They probably exist because of regulation, and that doesn't mean they need to act on anything LOL.

I think the fact that I engaged you on what you consider “direction” suggests otherwise.

You totally missed the relevant gist of the judgment indicating a lack of understanding to my mind and then chose to insult me. Sorry, but I won't engage with you any further.

I am disinclined to selectively invoke isolated excerpts of a finding or ruling while representing such determinations as being of universal applicability, independent of their specific factual or legal context. See, I can also drop the legalese. You’re insulting everyone.
 
I'm sorry for your loss. I would have assumed you could have sued with compensation going to the deceased's estate?
the problem lies with quantum, in terms of any award.

assume the patient was a 30yr old engineer, married with two children.
an award would be fairly substantial given the loss of future earnings / support for dependents

then assume the patient is an 80yr old pensioner.
there would be no loss of future earnings, nor compensation for support of dependents (pensioner is unlikely to have ppl financially dependent).
in this instance an award is likely to be punitive in nature, and not of significant quantum.

in the 1st instance, the potential award can make it viable for a law firm to pursue on a no win - no fee basis.
in the 2nd instance, the award is unlikely to come near to even covering the significant costs involved in this type of civil litigation
