Huge Issue with IRP5 please need help urgently!

Hi,

My husband last received a IRP 5 in 2008. The 3 companies he worked for between then and Aug 2011 never gave him IRP 5 even though they deducted tax from his salary. He went to Sars last year November and they could not locate any information for those 3 years. They told him to go to the former employers and get the IRP 5 or have them sign a letter stating they don't have it. 2 of the 3 companies has been liquidated and the other is just ignoring him and won't sign the letter.

We did his e-filing last night with the IRP 5 he got last month and it says he should get a refund of R5900. But it also states that no refund will be made untill 2009/2010 and 2011 returns are filed. Which he can't do as he can't get any information or a IRP 5 out of the companies. We don't know what to do??? Sars just says they need the info. He also didn't get a proper payslip at the one company just a piece of paper with amounts written on it.

Any advice would be greatly appreciated.

And that didn't raise any red flags at the time?

I would say that your best bet would be to get in touch with a tax practitioner and take it from there.
 
I may be wrong here, but isn't the CCMA the body that was basically formed to help you guys out with this sort of thing? Maybe give them a call and hear what they have to say?
 
We did go to the CCMA right after they didn't get paid for 2 months at both companies, and they can't do anything as the liquidation has not yet been resolved. The other company has several CCMA cases pending against them.

Yes it did, but if you haven't gotten paid for two months and that is the only job you could get wouldn't you have taken it too?

Please visit your nearest Department of Labour and ask one of the nice people there to assist. They will give your husband a letter forcing the company to provide the information or they will be hit with a hefty fine.

The other issue of being liquidated - get the liquidation order information and seek out the liquidator to provide you with the information or confirmation and present that to SARS.
