iBurst speed claims not allowed

In light of the above finding, the respondent is required to:

  • withdraw the claim in its current format;
  • the process to withdraw the claim must be actioned with immediate effect on receipt of the ruling;
  • the withdrawal of the claim must be completed within the deadlines stipulated by Clause 15.3 of the Procedural Guide; and
  • the claim may not be used again in its current format until new substantiation has been submitted, evaluated, and a new ruling is made.

15. Enforcement of Rulings

15.1 The responsibility for adherence to a ruling made by the Directorate or ASA Committees lies with the person against whom such ruling has been made.

15.2 Once a ruling has been given by the Directorate or ASA Committees, it shall be the responsibility of the complainant to monitor whether or not the ruling is adhered to and carried into effect.

15.3 Where an advertisement is to be withdrawn in terms of a ruling, the advertisement shall be withdrawn as soon as possible, but no later than as set out below:

15.3.1 Newspapers - immediately as deadlines permit

15.3.2 Radio - immediately as deadlines permit

15.3.3 Television - immediately as deadlines permit

15.3.4 Magazines - immediately as deadlines permit

15.3.5 Outdoor - 2 weeks or as determined otherwise by the ASA

15.3.6 Pamphlets, posters & leaflets - as determined by the ASA

15.3.7 Packaging - 3 months or as determined otherwise by the ASA


15.4 Should the respondent ignore a reasonable request for co-operation, the ASA will issue an Ad Alert to its members (including newspapers, magazines, radio, television and the Printing Industries Federation).

15.5 Offending advertising is to be withdrawn from every medium in which its appears, notwithstanding that the complaint did not specifically refer to that particular medium.

In other news, Superman has been told to stop advertising his faster than a speeding bullet slogan as he does not say from what type of gun the buttet is fired.....:rolleyes:

So I guess the Kryptonite the DoC, ICASA and Telkom are smoking are not helping matters?

for what it's worth, I used to get speeds upto (and more) than 17x faster than dial-up.

On their Packages page, it still clearly states "Speeds 17 times faster than dial-up" (not even those lovely words "up to")

The ASA ruling makes no special mention of website advertisements, so it was supposed to be removed immediately after the ruling :rolleyes:

The "17 x faster than dial-up" bit has been removed from the weather report:) But it has been replaced with "from 12c per MB". Looking at their pricing below:

What about the 10MB bundle from MTN?:confused:

I doubt they offer it with a data card though, I can see a use for that in using Opera Mini, email on your phone etc. but not as a primary connection. This is clearly designed to be used differently.

Ok I see your point:) Some of the figures in the above pricing doesn't make sense to me --> on the bigger packages the difference between the contracts with modems and the one without is more than the 40MB specials that include modems:confused:

I was thinking the same thing, makes more sense to take out a 40MB contract to get a free modem and then get another account with no modem. At least then your contractual obligation's pretty low too. :)

AFAIK it is near impossible to actually do that with iBurst SA bcos the UTID is tied to a specific account, which means that you have to 'know' someone at iBurst SA before you can have more than one account - or change from account A to account B, that is linked to a specific UTID.

Oh ok, that explains how they manage to charge such extortionate topup fees I suppose.
