was doing some research and found this in the ICASA Act of 2000 - this is the Act under which ICASA is formed and which regulates the manner in which it operates

"Section 3 – Establishment of Independent Communications Authority of South Africa
3(2) The Authority is independent, and subject only to the Constitution and the law, and must be impartial and must perform its functions without fear, favour or prejudice.
3(3) The Authority must function without any political or commercial interference."

ICASA Councillors should have an oath of office:
"I will be independent. I will be impartial. I will perform my functions without fear, favour or prejudice. I will request that the honourable minister mind her own business. I will not tolerate the honourable minister making a fool of me by changing my decisions at the last possible moment. Telkom is not my friend and its shareholders are not my concern.The affordability of communications for all South Africans is my mission."

If i look at the above sections and consider the power to impose all sorts of funky restrictive conditions on telkom that ICASA will probably have under the new Convergence Act, I realise more and more that these guys are our one real hope..

so send them all the relevant info, be polite, be co-ordinated and be sure to hug an ICASA councillor today
 
Yep, I came to the conclusion a while back that the problem is not ICASA at all - it's Poision-I, she has the final say, she decides not to rattyfy ICASA's recommendations by signing them into law by Government Gazettation.

The only thing I am not happy about with ICASA is it is somewhat disorganised in the communicate with the public department - I want to know by email notification everytime ICASA gazettes something, or calls for public participation...if we know about it we can participate & help make it robust & just, if we only find out about it at the last minute then we cannot give it sufficient attention.
