that would be my absolute minimum if we are relying solely on regulatory intervention through ICASA and without any court action along the way

as you know time periods are difficult to predict in this industry and generally prove to be longer than anticipated

ICASA obtains its charter through the Independent Broadcasting Authority Act 153 of 1993.

If the current government are really serious about overhauling SA's telecoms sector, what prevents Parliament from either scrapping this Act or amending it significantly?

Public participation? An all-inclusive consultative process? (that will include the incumbents who will delay the process for as long as possible!). Political will?

ICASA was created and is governed by the ICASA Act of 2000 as amended (as well as indirectly by the Postal Services Act, the Broadcasting Act and the ECA). The IBAA has been repealed.

We have ICASA mainly because South Africa signed up to the World Trade Organisation Agreement on Services and the Annex relating to telecoms in particular. This required the establishment of a regulator which was independent from Industry.

The ICASA Act does need to be amended, particularly as regards corporate governance issues, but since it was founded it has never been given sufficient resources to do what is required. At times it has been actively frustrated by its political masters and at times it has managed to shoot itself in the foot without anyone's help.

throwing more resources at it would be a start but political will remains the key to this and we will have to see ...

interestingly the new minister regards ICASA as being a rebellious institution after the Vodacom deal debacle and their performance is very much under the spotlight
 
So we are basically pinning our hopes on political will?
