This is very worrisome! It is amazing that ICASA will say that – it basically means that they will not make decision on objective truths, but rather to avoid litigation. This in effect can mean that when a consumer complains they will rather take the operator’s side since the consumer is less likely to sue!

Maybe we should start our own "War Chest" fund... Register a section 21 company, and those who wish to contribute may make donations. Then once we feel like we have enough, we can instigate legal action against who ever we deem warrants it at the time.

We can call it the Telecoms Libralisation Fund (TLF)

rpm, ICASA is flipping paranoid about being litigated against. It's written all over their strategy documents and business plans.

This attitude from ICASA can be used to our advantage.
 
i.e. we have bent over backwards to please (a) the Minister and (b) the big licencees because we aren't terribly concerned about (c) the general population and (d) anyone else in the industry

this document is appalling - it has no internal logic, does not divulge any reasons and is simply badly put together

unfortunately for those in ICASA wishing to avoid litigation they should have paid a little more attention to the law and given less emphasis to politics

i have no doubt that this will end up in court shortly
