Immigrating to the UK

If you are interested I have a long running blog on another SA forum on how we exited SA via SARS and SARB and the requirements on registering residency in an EU country. Red tape and frustrations are all logged there. It is 24 pages long and has almost 100 000 views. We are now relocating after 4 years once again so will keep it going.
Had I read my own blog before emigrating I would have saved a ton of money and had less cardiac events.

We met with the social worker today and his 4 year old biological sister will be placed with us at the end of November. We also discussed our plans and will be starting the adoption process for both of them in the next few weeks. The social worker agreed that they will assist and recommend that adoption is in their best interest.

It will be one adoption for the both of them. Only issue right now is that the sister's birth was never registered at Home Affairs and they have applied for late registration of birth. Home Affairs currently has a backlog and is only working with applications for late birth registrations that was submitted in 2016.

In short it states that your spouse needs to earn at least £ 18 600 pa for you and if you have 2 kids then it increases to £ 24 800. Chapter 2.4.

You may get an exemption for the kids under Chapter 2.8.

The earnings can be foreign earnings over the past 6 months, the latest payslip not being older than 28 days from application date. You must then provide proof that your spouse will be employed in the UK within 3 months and the salary must be stated.

You can supplement the required minimum amount with savings or investments either your own or combined with your spouse's.
Amount less £ 16 000 divided by 2,5 can be added to the income earned. After 2,5 years you must recalculate it and submit. After 5 years when you apply for ILR (Indefinite Leave to Remain) you need not divide by the 2.5.

You really aren’t very good at learning how to quote or tag, are you?

If you want to tag someone, use the @ and don’t leave a space, as you type their username it will pop up on screen for you to select. Just click/touch the one you want.

They will not be a dependent on a family visa so the financial requirements will not apply.

They will be adopted in South Africa and the adoption will be registered with the GRO in the UK as a foreign adoption. They will then be issued with British birth certificates as their adopted mother will be a British citizen settled in the UK at the time of their foreign adoption.

They can then apply immediately for their own British passports so will not need any visa and not be counted as dependents on my application.

Correct. The financial requirement is only applicable if both parents are non-British citizens.

Read the link I provided above. It clearly states in the INTRODUCTION that there are financial requirements for non EU members with a British partner.
The OP will need to provide proof of £ 18 600 earnings as I also clearly stated in my post.

I think he was specifically referring to the additional financial requirements needed for dependents which are exempt if the dependents are British citizens.

My wife's application for a new certificate of entitlement has been submitted. Appointment is for next week Friday. We will be submitting her long form uk birth certificate that we ordered from the UK, 2 passport photos, a copy of the expired certificate of entitlement and her current South African passport.

We are hoping to get it approved before the end of year break but reality is that we might only get it closer to the end of January.

Next step would be for me to get all my supporting documents required for my application which will include an employment offer for my wife in the UK.

TLS Contact, the company that handles uk visa applications, are a joke.

My wife went in for her appointment and none off their staff have ever heard of the Certificate of Entitlement. When I login on their website to track the status of the application, the type of visa indicated on the website is "Visitor less than 6 months".

I sent them an email this morning to query this. Hopefully it's just their own internal system and does not impact how it gets sent to UKVI.

My wife went in for her appointment and none off their staff have ever heard of the Certificate of Entitlement. When I login on their website to track the status of the application, the type of visa indicated on the website is "Visitor less than 6 months".

I sent them an email this morning to query this. Hopefully it's just their own internal system and does not impact how it gets sent to UKVI.
She should have logged it on the website herself, then take the forms to TLS on the appointment date.

Im sure she will get the 6 month visitors visa though.:P

Don't think they will give the visitor visa if you qualify for a higher visa. From what I read up, if you qualify for the certificate of entitlement, they will not grant a visitor visa. We also only submitted her original UK birth certificate and a copy of her expired certificate of entitlement. None of the stuff required for a visitor visa like proof of funds, flight details, etc.

Will see if they call back today.
 
There's also a massive price difference between a visitor visa and certificate of entitlement. It was R7 500 for the certificate of entitlement.

On the Visa4uk website we selected the right option, the appointment also had the right option. It was the confirmation that TLS printed out from their system that they received it that had the incorrect visa type. 20181112_100802.jpeg
