Tell me Devon, If I were to get a legal company to go to court to have my debt review removed as I am no longer over-indebted. Would that affect the prescription from taking place later this year?

But to get back to the OP, let us know what the Credit Bureau said with regards to the wrong information and if they can correct it. You will probably need to contact the big ones as they will usually have this information.

Have you installed ClearScore and see if that shows any information that is helpful?

No. If you are able to get the debt review legally removed, you are still liable for any amounts owed. Clients only go this route if they feel it will take too long to settle everything under debt review. Once the order to be removed is granted, you pay the remaining amounts outside of debt review.

Yes, but I got kicked out of debt review because I stopped debits from Hypen. What I am trying to understand is, will I not disrupt prescription if I get debt review removed from my credit profile? I would obviously do this through the court process.
 
The financial institutions are far worse than the defaulting debtors. Please don't for one second lose sight of that. As for collections companies, I couldn't care less about them. With all that said, I would not run away from my debt if I had the means. Also, I don't think it's on to judge if you don't know how I got to not being able to meet my financial obligations.

If it makes you feel any better, I am still paying for my vehicle and property finance. I know you think I'm cheating you as you have been honouring your debt probably for years.

My cheap vehicle and property are both still under finance and are up to date. I will be free come December boss!

You cannot be kicked out of debt review. You were most likely suspended.
From past dealings with clients and attorneys, whoever you choose to help must prove that you are not over-indebted. If it comes out in court that you still owe R600K, it could be rejected. Most people use the paid-up letters to show that they only have a few accounts left and should be removed from debt review.
Going to court might make things worse if you are asked to prove what has been settled and what remains.
 
Thank you for the response. I really appreciate it. I think the safe bet is to wait for the prescription before removing debt review. Either these companies that specialize in removals lied to get me to pay for their service or they have ways of getting around the questions posed by the court as you have indicated. The only reason I was looking at this option before prescription was because I know the process takes some time and did not want to wait further to have a clean credit profile after prescription.

Which is why I disagree with OP's actions being described as theft.

If he borrowed the money with no intent of repaying it then that definition could be justified, but if he entered into the agreements in good faith with every intention to repay then it could never be regarded as theft.
But he is not insolvent.
He is hiding from his creditors in the hope they miss the prescription date

There seems to be intent there. Even if it was after the loan

If you borrow my power drill ... thats a loan
If I ask for it back for 2 years and you ignore my calls and mails and deliberately evade me... then there seems to be intent to deprive me of my drill

It may not be theft... but its close
 
OP I told you to ignore these nut jobs, Dont pay a cent back, your original creditors dont care about the mere R300k you took or else they would've collected it by now, they decided to sell the debt to someone else whom you weren't in agreement with, Oh and by the way once you start paying those scummy lawyers watch how the amount you owe will never come down, so you will be paying them for the rest of your life. Eff them. The system is only there to **** you up and it is never in your favor. I dont know why the people here are so pressed when the people you owe dont even care.

Then why are we rehashing this if his question has been answered, Op has already said he is not paying anything so can we move on. He owes scummy lawyers not the banks anymore. You are welcome to start your own thread about right and wrong, you may include a poll too if you would like.
