Insurance 3rd party claim

Good morning all and thanks for your advice. I listened but yesterday afternoon (around 5) when I was to contact my insurance he called me to ask for my details. Later he forwarded an email to me where his insurance wants pictures of the damage. I am now waiting for him to give me the claim number because I need to include that in the subject line when sending the pictures.

Now what I want to do, as soon as I get the claim number I want to inform my insurance and give them the claim number. Apparently, it is not going to be cheap as per panel beaters I went to. New fender, light spray (whatever its called) and possible chasis damage...

I just want to get my car fixed so that I can put this behind me

Go to your insurer.


If this goes wrong and you ask them for help afterwards they will decline the claim/help.

The other guy's insurer will stand for him as he employs their services.


Your insurer also has access to lawyers should they be needed.

I hear you. But can I claim from my insurance while his insurance is processing a claim for me? I am still new at this claiming thing so please understand if I ask questions that seem to be stupid.

Yes, you can provide them with his claim number afterwards, you deal with yours and he deals with his, as long as he lets them know there will be a third party claim coming through. You let your insurance do the work, you pay them for this.
Unless you've made it 100% clear to your insurance that you will be doing a complete third party claim and not involving them, you should get your insurance involved soonest. As soon as an accident happens, you're on the phone to them to sort things out. Police numbers and other insurance claims you can provide them within 24 to 48 hours.

I very much doubt his insurance cares about your damage. They want your details because that's how its done. Claim from your insurance for your damages. It's how the whole system works.
 
Okay, claim registered. They will assign someone who will follow-up with the 3rd party regarding the claim if it is taking long and provide me updates and if the 3rd party rejects for any reason I can ask them to repair my car and claim my excess. Most importantly if the 3rd party fixes the damages the claim gets cancelled on my policy and doesnt affect my cash back.

His claim has nothing to do with your need to register a claim with your OWN insurance. That is for them to sort out.
 
1.) You will not get the full amount from his insurance, even if successful - you will be held partially responsible.
2.) It is going to save you quite a bit of stress just going through your insurance.
 
Note to self - I really need to follow up on our car insurance, see what we're covered for, what our excess is, do we get courtesy cars etc. I've got nary a clue which is scary.
Only thing we've claimed for in the past 7 years or so has been window repairs.

Yes, always good to refresh ones mind now and then.

And it is not a courtesy car, it's a rental car.

Thank you, everyone, for the advice. Much appreciated. I registered the claim with my insurance and they will now contact the third party etc and provide me with updates. and the 3rd party rejects they will fight etc but I can also ask them to fix my car and claim from the tird party

Why not according to 1? On third party claims I've had 100% payout and they've recovered my excess from the other company, depending on the type of collision.

I think he's referring to if you try do the 3rd party claim on your own and don't do it via your own insurance, the 3rd party may claim its a 60/40 responsibility split and only pay you out a portion, whereas claiming via your own insurance they will do all the legwork and ensure you are fully covered.

This. The OP probably won't have the resources to challenge the guys insurer on his own. Even some guy driving into the back of him won't make him 100% responsible.

a guy drove into the back of me in 2014 and I claimed successfully from his insurance, he was 100% responsible.

Because the guy was nice about it and did the right thing.
Some people don't take responsibility or only partial and then you'll have problems getting everything paid.

Good day everyone

Need some advice. Someone rammed into my car on Saturday night. We did the AR and I have the details. Now apparently he needs to register the claim on his insurance if I want to go 3rd party. Or else i can do the quotations and ask my lawyers to persuit him. I am getting frustrated now. The guy hasnt registered the claim as agreed.

Any advice? I am trying to avoid claiming from my insurance because even if I go that route I still need his insurance claim number if I want to recover my access. Or else I just cut my losses and fix my car. :twisted:

You have insurance for a reason. Don't stress yourself up. Lodge a claim against your insurance and let them deal with it. I would much rather pay the excess and get it back eventually than stress myself with other people's issues and having to probably drive a smashed car during all these delays. You pay a lot monthly. use it...

Isn't that because you're awesome and have millions in properties? Partial responsibility is quite commonly accepted in South Africa - not that I agree with it.
