Jail sentence.

Evening everyone.

Hoping to find some info among you talented lot.

Someone I know broke the law (Theft) 4 years ago. In July this year the court case finally came to a close and she was sentenced to 3 years. (Pollsmoor).

Now I know, you do the crime, you do the time, however she is married with 3 children and her husband is really picking up strain. He puts up a brave face for the children and they seem to be coping well under his wing, but I had a long chat with him and he told me the stress is killing him. He struggles to concentrate on work, the list goes on and on.
He told me that he still loves and will not divorce her.
Also I saw them going through hell the last four years. I also think the whole thing scared her onto the straight and narrow.

So I was wondering, is it possible to have a first offender's sentence changed to say house arrest and community service. If so who would we need to contact or where should we start?
Are there any other options??

And then just out of curiosity, how many of you lot has a close friend or relative that went to jail??

I would imagine early release would depend on her improvement of self and others. It's called 'Correctional Facilities' after all. A dumb name considering it does more harm than good most times.
 
This^ I mean they don't just send people to jail for shoplifting?

Given the circumstances (kids etc) I would have thought suspended sentence at the most. Think there might be more on the rap sheet.
 
She stole money. In the region of about R80k over a period of time.
 
As i understand she is on their books as a first time offender.
Parole in 18 months which is still a long way to go. Worried that my bud is gonna lose his mind.
 
I went with the one day for a visit at pollsmoor. Not a lekke experience. Wait almost six hours for a 15 min visit.
 
Historically jails are not supposed to be a nice place, only recently changed in places like Europe. Better you speak with a lawyer in criminal law about appeals and whatnot, unfortunately that route adds financial stress.
 
She stole from her employer?

I have had similar cases of bookkeepers stealing a lot more than that without getting jail sentence. I guess it depends on the charges laid by the person the money was stolen from and the circumstances. Pollsmoor is a bit unlucky.
 
That is a harsh sentence. When does her sentence start, is she already in prison? Me thinks you would have to consult an attorney about possible options.
 
this is an actual serious crime and needs to actually do the punishment.

i do feel for the husband, but what message is being sent that people under stressful circumstances are treated better? i think that's a load of crap. she had no problem stealing the money and didn't think about what the consequences would be cause she was to selfish.

the fact that she stole from her employer (well, i am assuming that, wasn't clearly stated) is even more sickening cause she was giving the trust by her employer. who knows what that money was going to be used for (i.e. bonuses, annual increases).
 
As a member of society I would personally be happy with house arrest for the period of her initial sentence. There is no need to punish innocents, the children and husband in this case.

Forward thinking societies would come up with much more humane yet effective methods of correction instead of throwing a mother of 3 children into a hell hole like Polsmoor for what is a non-violent crime.

I can feel for the husband and the kids, but didn't hubby realise something was weird when she suddenly was buying new things etc?

She needs to serve 1/6 of her sentence to be considered for parole. So 6 months and she could be out. 6 Months fly by so quick, sure they'll get it sorted. However, think of the poor woman who needs to serve 6 months in one of the most notorious jails on the planet :eek:
