Chief Justice Mogoeng Mogoeng and deputy chief justice Dikgang Moseneke respond to recent comments made by ANC leaders.

Last month ANC Secretary-general Gwede Mantashe accused the North Gauteng High court and the Western Cape high court of having a negative attitude towards government.

Mantashe’s comments came in the wake of the North Gauteng High court ruling to arrest the Sudanese President Omar al Bashir.

The court ruled that the government had a duty to arrest Bashir. However the ruling was subverted after it was revealed Bashir had already left the country, despite the court ruling that authorities must keep him here.

Government is appealing the ruling. Mantashe said the court was acting against the interest of the state.

this may be worth watching, though I am still worried mogoeng is a zuma yesman deep down.
 
Judges laying down the law is like class prefects trying to quieten a rebellious classroom.
 
The 2005 case of State v Moipolai involved the rape of a pregnant woman by her long-term boyfriend. Despite several aggravating factors, Mogoeng reduced the man's sentence from ten years' imprisonment to five because the rape was, he said, not as serious as if a stranger had committed it.[22] Finally, in State v Mathebe, Mogoeng reduced the sentence, from two years' imprisonment to a fine of R4,000, of a man who had tied his girlfriend to his car and dragged her 50 meters along a dirt road. Mogoeng's explanation was that the man had been "provoked".

What? He has been an excellent Chief Justice. Don't disparage someone just because they were appointed by someone you don't like

I have given some of my other reasons as well. Including the fact that he was appointed over more senior, qualified people, by someone with a track record of making flawed appointments.
It's not based on "I don't like".
Granted, so far he seems to have been done well, but I think we're getting to the crunch now. Hopefully he continues to speak truth to power.

Any judge serving in the concourt is qualified. Many though Moseneke would be a better candidate than all the others given his seniority but he shot himself in the foot running his mouth against the ruling party - there's no way Zuma was going to appoint someone who is openly hostile to his party.

I would have preferred Moseneke as well, but Mogoeng has been very good so far. And I especially like his focus on ensuring the Judiciaries independence

Indeed, but as I said, I think today is the crunch.

No. Because he was appointed by Zuma over the heads of more qualified and experienced judges, despite some of his judgements being decidedly in conflict with the constitution.

EG: " In State v Sebaeng, Mogoeng reduced the sentence of a child rapist on the basis that he had been non-violent and indeed "tender" in raping the victim."

If I recall correctly: the other senior judges, in the running, did not want to take the position...
 
Coming from the Judiciary to the Executive, that is a very strong statement!

How do you reach the conclusion that he has been an excellent Chief Justice?

It's interesting that when the executive does the same thing then people cry foul.
