Hi all telecoms legal gurus

1) Can I (as a company in the middle of no where), cross a road legally with a wifi (802.11g) signal for the sole purpose of connecting my two networks?
2) If not, what do I require to be able to do so?

Any comments or legal references will be highly appreciated.

ah the million dollar question :)

strictly speaking and as the law stands the majority answer would be no (although this does not seem to have stopped many people from doing it)

ICASA would prefer you to use telecommunications facilities obtained from a licensed operator...

there are events happening at the moment which should bring far greater clarity to this area of the law shortly

It's imminent :D

You would need to obtain a license to even use smoke signals, as it is using a communcation method, which is not obtained from one of the companies that have a license.

Legally I think you are stuffed. Practically - go for it and stuff them!

errr what are u all smoking
wifi is radio signals yes? law states u cant cross the road with wires that is all
@PeekNPoke dont put a signal booster on either side and u are in the clear

/sortof offtopic
Hey WW.

Your post made me think......I wonder how much slower technological progression would have been for mankind if government had always had the laws as we do today?

A sort-of "forwardsight from hindsight", if you will.

Um no it doesn't. The law regulates radio transmissions as well.

Its only illegal if you get caught. :D Not likely in your situation.

I'm hoping that when these events are allowed to become public you will translate whatever gobbeldygood is fed to us for those not quite as sharp.
Anticipation imminent....

Well the one interpretation I've heard about this law is that it is actually illegal to shout to someone across a road.

The problem is in the definitions that the law relies on.

Not entirely unrelated to this- this is how we all got screwed with the ADSL regulations - definitions and meanings that were obscure.
