Logo design process

For R50 I can accept what I received, but this is a reputable company and I paid nearly R5000 which they refuse to refund because 1) my complaint is cosmetic and 2)their designer spent time on this and will be at a loss.

All this designer did was to go and source images from colouring book sites and free image sites and type my Company name in Ariel Font below the images. She then proceeded to present them as her own concepts.

Well thats unacceptable...
 
You could have spent less on a Crowdspring campaign and enjoyed dozens of high-quality original submissions to choose from. Keep fighting for your money back. Threaten small claims too.

Small claims is a good option, also bare in mind the consumer protection act. I have used it a few times when faced with delinquient companies... Its a good read (ok, only if you like that sort of thing) and packed with punch.
 
Outrageous for R4900, try get your money back then go from there. Also why was there no deposit for first scamp etc?

You'd have more luck with Fiverr or something.

Fiverr generally sucks a lot. Crowdspring will produce far higher quality content.
 
yea we I logo design in part and its so easy to spot something that generated of the web. Standard procedure as far as i know is three designs and then you pick one and get a number of variation requests on the design. Most companies work this way.

R5000 for a logo design and branding ? Geezzzzzzzz Does it come with buying customers ? Blatant scammers they shouldn't be in business too long but you have the evidence if you could get hold f the person who put that on etsy and tell them they will might also get on his back. Hindsight is 20 20 i know but background checks with web designers to logo designers whatever is always a good thing.

What does the invoice say ? Logo Design ? Custom logo design? Or brand identity package?

Take legal action,maybe they will buckle

It sucks a lot, but still better value when you compare what's in this thread.

I've had impeccable comprehensive CIDs done for new companies which include logo, business cards, tshirts etc for less than R2500 by freelance designers in Cape Town.

This is wild.

Face it:

1. You got ripped off.
2. You f**ked up by paying in full up front.
3. You f**ked up by not doing research before putting your money down.

The time & effort you are going to expend in trying to get your money back will be worth more than the R5k. Take it on the chin as school fees & source the design elsewhere.

Some pointers:

1. Request that you get it in open file (not password locked) vector format with all lines converted to curves - vector .pdf is ideal for most laypeople. Also request it in large format .jpg that you can resize for use in email signatures, web etc.
2. Ask for the different RGB/CMYK or, ideally, Pantones of all the colours in the logo as this will make your life much easier should you ever want to print it onto shirts etc.
3. Pay 50% up front, balance due upon completion. Designer must specify how many options they will present & how many changes are included in the price. Specify no free or stock online images to be used.

Terrible advice. I would not stand for this. It's the principle of what they have done, and I'd ensure I get every single cent back.

I'd also let the public know via FB and the likes of their business practices.

If you have got both the time & bitterness to carry a grudge around with you for months or years and/or if you're happy to be served with a lawsuit for defamation & slander by all means go ahead.

In regards to getting money back via small claims court, that's a R100 fee for lodging the case and showing up on the date, no lawyer fees.
I don't think any money will be lost in terms of time spent on it.

Regarding slander, if OP wins the small claims court, no way they have a case. I woukd even go as far as to say that it's not defamation as OP only showed off their work, if their work is shoddy, it's their fault. Again, rather finish off the small claims court case before doing so though.

Defamation for just showing what they gave you for R5000 and what you could have bought of etsy for $5?

You should rather not give advice online. According to your logic everybody who have ever complaint about bad service on sites like hellopeter or gave a bad review on a product could be suit for defamation and slander, that's just stupid on a whole new level.

Nameing and shaming a bad company is a public service and can posibly safe other people R5000. It is also nothing like carrying a grudge.

Small claims - what are you claiming for? They provided you with various options of logos. Just because you do not like them does not automatically mean you are entitled to a refund. Just because you can find similar elsewhere does also not entitle you to a refund. Why didn't OP go to etsy & buy/rework the logo?

rietrot - suggest you read up on the legalities before trying to comment. I've been down this road. Client ordered goods. Upon delivery she decided she did not like them. Engaged with her over a period of 5 weeks, to no avail. Replaced the item - same problem as before. She was incapable or unwilling to read the T's & C's and specs of what we were supplying, which were very clearly pointed out to her. She decided to bad mouth us on social media. Ignored repeated requests to desist. 1 x protection order, followed by legal action for slander. R25k settlement in our favour negotiated by the attorneys, + she paid all costs. All in the silly tart lost R38k for an item that cost her R1,200. So please, by all means, continue to dish out your "advice".

The OP was ethically ripped off. Law does not work with morals & ethics, it works with contract & laws. The two are not the same.

Slander is by definition defamation... and it's spoken, not written.

I just want to check with designers out there, is it the norm for a company to advertise corporate identity services (including logo design), and then simply slap three images from 'free image sites' onto a PDF, type my company name under the image and call it their concepts?
Just because the images were on "free" sites doesn't mean that they are free from copyright. You could, and should, track down the creators of the original images and see. Might give you leverage.

Truth is total defence against defamation.

As long as op doesn't lie about the facts in the social media posts the company can't do ****.
