Johannesburg - A man who was robbed of his cellphone has been charged with murder after he shot one of the robbers in the back, police said on Monday.

The man - who was walking near the Holomisa Squatter Camp at 10:30 on Sunday - was approached by a group of men who stole his cellphone and fled on foot, said Captain Stephen Marais.

"It is alleged that the man chased the group and fired shots with a licenced pistol, killing one of them, an 18-year-old youth," said Marais.

The 39-year-old man was arrested on a charge of murder and would be kept at the Duncan Village police station.

Right or Wrong?

Give the guy a slap on the wrist and tell him to stop playing with guns, itll get himself killed. But dont charge him for killing some thieving scum - if the cops arent doing anything about crime, the people will take it into their own hands, except then the cops turn on them instead of the actual criminals. This system is f*&ked up.

I'll shoot a criminal any day, i'll just make sure I have a pretty good lawyer.. I mean, if the government / SAPS is so stupid, then chances are good that a bad ass lawyer should get you off...
 
Ag it is just some legal inconvenience since the robber wasn't facing him. He will get off
 
While I dont disagree with you guys, in this case the shooter is in the wrong according to the law
 
I can't believe the attitudes here! Yes, theft is wrong, but it's not a mortal crime. Allow anyone to shoot anyone for any crime, and you've gone back to vigilante-ism and mob rule.

I understand the frustration with theft and crime, but calling people like animals and saying they deserve to be shot... I can't just sit here and read that and not speak out.
 
I think the problem is theft here often turns into a mortality crime. You dont know which theft is going to end up in you dead.

In general, yes, but these guys were running away.

I understand wanting to be safe. I understand that in the moment, you're just so angry and you want to stop them. I can understand the guy shooting them, although I don't agree with it.

I don't agree with people sitting at their PCs saying that people deserve to be dead and calling them animals. I know I'm in the minority view here, but it's something that often comes up on these forums, and I normally just keep quiet because I know I'll be shouted down. But I figure if I don't say anything, it seems like everyone agrees with the posts. I'm just trying to point out to... I dunno, posterity I guess... that not everyone thinks that way.

Sadly, this will not happen. Even drawing a pistol and pointing it attracts a docket against you (unless you are in the SAPS of course, because many laws don't apply to you).

For someone that has a valid gun license he should know never to shoot anyone in the back, You can only get away with shooting someone if they are a threat to you or someone else. also killing a man that stole your cellphone is just as bad as killing a man to steal his cellphone. all i can say is he should have stopped to think before opening fire.

Reminds me a little of the story of the man that was robbed of his wallet containing his gun license, he went to cop station to report it and got arrested for carrying a weapon with no license.

People are killed for their shoes and mobiles. I see it as one less person that could get hold of a weapon on another attempt and rob me of a friend or family member. Share your sentiments with the family of those that have lost loved ones.
 
wtf? i'd shoot him in the bawlz and then if the police wanted to arrest me for defending myself, i'd shoot them in the bawlz too.
phuck that ****. they protect the criminals and charge normal people with ridiculous crimes.
 
no merc, shooting someone who running away in the back is murder man

the oke was running away, he pulled his gun and murdered him

simple straight forward

i understand the need to protect yourself but someone running is no harm

but yea criminals do get protected in this country no doubt about it, but i would never shoot someone in back and face jail for my cellphone which my insurance would replace
 
I have no problem with it. Respect other people's property and you won't end up dead.

I agree with you 100% Cathryn. The shooting was in no way self defense. Not acceptable. I find it amusing how people on this forum are so quick to point out how disgusting it is when somebody murders someone over a cellphone, when to all intents and purposes that just happened here too, but this time it's ok.
