Man Shot robber in the back

Was a police reservist for 5 years. We look after ourselves as we do the state and public a favour for free. We dont have time to go to court as we work just like you do. The unsaid rule is if you have to shoot someone, you kill them. Its a sad truth.

Ah, now that's different. Having been a reservist, I'm sure you were exposed to a lot and have faced a lot of challenging situations.
 
IMO what's pertinent in this particular case was did the penalty fit the crime and unfortunately for the thief it probably didn't. I think the death penalty for the theft of a cell phone is a bit harsh and affectively that's what he got.

It mentions that the victim chased the thief, is one to assume that he told him to stop running or he would shoot and did he then fire a warning shot before firing the fatal shot??!! Was the thief given any opportunity to surrender??!

Again this particular thief was on the wrong end of the firearm and he paid the ultimate price which is perhaps far worse then the 2 years he may have got if convicted in a court of law for his crime.

But the bottom line is people are fed up with unacceptably high levels of violent crime and the SAPS despite their best efforts are not affective enough in curbing this crime so yeah, the man in the street has to go to great lengths to secure his/her own property and that includes fortifying our properties, alarm systems, arm guards and arming ourselves...

On whether the victim should be charged for murder, of course yes, it's routine but the charge will probably be downgraded once it is established that he was in fact the victim of crime etc it's going to be very difficult to prove he shot the thief in self defence because the guy was shot in the back running away, that already is going to cast doubt over his claim of shooting in self defense...

Just to de-rail the topic a bit and add a "funny" story : Was working in civilian clothes (undercover) at a night club just walking around outside when a bakkie comes screaming past me and almost knocks me down. I yell at him and motion with my hands to slow down. A approx 20 year old guy gets out the passenger seat and storms over to me with the intent to punch me (cause I was being cocky) (I was about 22) so I draw my firearm and point it at the ground. (Should have said I was police but kept quite)He shat himself, he comes up to me and says what a mate I am and shakes my lose hand etc then dissapears. I saw him 20min later that night crying to a friend over it. Made me chuckle inside.
Anyways if he did try hit me I wouldn't have had a second though on shooting him, and shooting to kill. My excuse, he assaulted me and tried to take my firearm.

Neways im not one for taking ****. If you endanger me or my loved ones and I can kill you I will.

Want to join the reservists here in CT again but my GF doesnt want me to :(

With regard to this case i agree with sandmanm34, while I do not condone the crimminals actions, the shooter was way out of line and will now pay the price

I will not murder someone. Ill kill someone with just cause. If my life was threatened or I felt my life was threatened during the robbery I would have shot there and then not waited for the robbers to run away. The guy who shot the robber was wrong as the robbers were no threat to anyone while they were running but he had full right to shoot them while he was being robbed and even though it would proberbaly be a lengthy court case he will get off with man slaughter.

The theft of a cellphone isn't why people would be happy to see a guy like this getting shot. He is in a gang going around mugging people, and would have no problem breaking into your house and then probably even killing an innocent person if he had to (or for no reason).

There's no chance that those guys were just stealing one cellphone because they desperately needed money. Its another gangster off the streets.

That is the problem. No longer self-defence. Now bordering on retaliation or revenge which the law will not tolerate.

yes it happens alot but to assume this guy could not get his life together and kill him over a cellphone is retarded

when i was caught shoplifting a packet of sweets at age 13, lets say i had to start running and got shot and killed would this be fine?

i mean i did steal so i should die right?

Of course I don't believe everyone kills, but what to say he won't?

Exactly. I am sure that the forumites making these bold suggestions would not be too happy if they were murdered because someone 'thought' they were going to do something bad sometime in the future.

Going in circles here, as stated already by law he was wrong. However I feel no remorse for the dead thief; he won't be able to do that again and in my books that's good. If you feel sorry for him, well that's entirely up to you. kay, thanx and bye.

Johannesburg - A man was shot and killed by a homeowner while he was allegedly trying to steal a car at Sunset Bay in East London on Tuesday morning, Eastern Cape police said.

Spokesperson Superintendent Mtati Tana said the man - aged between 20 and 27 - was seen by the car's owner near the vehicle, tampering with the steering wheel.

"The homeowner approached the man and noticed that he had a knife, a screw driver, a lock nut spanner and allen keys.

"The man threatened to stab the vehicle's owner, who then drew his hand gun and shot the suspect in the chest."

Tana said the man tried to run away but fell a few metres from the car and died.

The man was thought to be linked to a syndicate of car and tyre thieves who operated in areas such as West Bank, Greenfields, Sunnyridge and Sunset Bay.

Police were investigating a case of murder.

The docket would be sent to the public prosecutor to determine if self-defence was the motive of the shooting, said Tana.

I wouldn't boast too much about that incident. As far as I can tell you should never have drawn your firearm and he could have prosecuted you for it. He was not armed and was alone, therefore your life was not threatened. ..... that's what the police would say anyway.

Threatening to stab someone is not a caste-iron defence or reason to fire or even point a firearm. He must have tried or succeeded according to the police.
 
In general, yes, but these guys were running away.

I understand wanting to be safe. I understand that in the moment, you're just so angry and you want to stop them. I can understand the guy shooting them, although I don't agree with it.

I don't agree with people sitting at their PCs saying that people deserve to be dead and calling them animals. I know I'm in the minority view here, but it's something that often comes up on these forums, and I normally just keep quiet because I know I'll be shouted down. But I figure if I don't say anything, it seems like everyone agrees with the posts. I'm just trying to point out to... I dunno, posterity I guess... that not everyone thinks that way.

They are not animals I agree You are right THEY ARE WORSE. They are thieving barbarians, scum, low life's. They steal and would not mind killing for it. They belong in the times a few centuries back and so does the police for charging him with a criminal act when he was protecting the future of this country. So its OK if the B@STARDS rape you and run, You are not allowed to shoot him so he can murder rape and steal again. I think You should have your priorities in life checked.

What wrong with this scum society of ours is that the Government and their cronies think that criminals have a human right but they forget that these criminals took away someone Else's human rights and as thus should not and do not qualify for human rights or pity for that matter. Thats why we vote for criminals to run the show!
