Are you planning to get divorced at some-point in your life? Great way to start a marriage hey.

I got married in community. Divorce is to easy these days. I honestly dont know why most people get married at all.

You guys are missing the point. "With accrual" is fair towards everyone. It is about much more than divorce, it is about safeguarding your estate against creditors, estate planning etc.
 
Got a marriage contract with a combined will for R1200 at a attorney.
This was 3 months ago and in Cape Town.

Way I see it, all financial choices should be done together. Also, we dont have creditors and dont intend to get any. We are doing everything together. Through good and bad... not just the bits we want.
 
Most people do not plan on getting robbed or burgled or get involved in an accident, but they take out insurance in any case. It is the same kind of thing.
I get insurance because I think I might be robbed. In fact in SA I expect it. Its got nothing to do with planning its got everything to do with what you expect to happen.

Not everyone sees choosing a marital regime as being about plannning. I was addressing the poster on his remark.

Look, I respect your POV, but let me sketch you a scenario -

Our house is in my wife's name (married OOC with accrual). I've signed surety for various business ventures' finance facilities. My estate is exposed in the event of the sureties being called on. In my scenario our house and my wife's estate is protected. So she is better of because we married OOC. It has nothing to do with divorce. It's about structuring your estate in such a way as to be the most effective for both of you.

Just returned from doing the consult and discussing all the options. Very happy with the service.

We are paying R650.00 including everything.
After the wedding we will also have them draw up our Last Will and Testament.

Please don't buy online or look for the cheapest lawyer you can find.

I went to a top attorney in Sandton who specializes in contracts.

I paid about R6000.

Paid it with a smile.

Doing it properly now and paying a little more, can save you if worst comes to the worst.

He did my will too - about R5000. I sleep easy knowing my affairs are water tight.

Never go for the free-will-from-the-bank thing either.

If you needed a heart transplant, would you shop around for the cheapest surgeon?
 
All I can say is, good on you for being able to afford R6000 for something like that.

Unfortunately we are not in a financial position to get the most respected and best law firm to do a simple contract.
Very good friends referred us to the firm currently doing ours. And they do not charge an arm or leg for it, so we decided to go with them.

Yes around there.

I got married at 36 so could afford the costs. Also had assets to protect. The contract required a separate addendum. About a 20 page document all in all.

I did not go to a big name firm.

Just one guy in his own practice.

He is a stickler for detail, leaves nothing out, crosses the t's and dots the i's.

A good lawyer will use his years of experience to cover you in any eventuality.

A one or two pager from the CNA ain't gonna do that for you.

I would prefer not to part with money to a bank or law firm; therefore better to make someone you know (friend/relative/etc) the executor of your estate.

I have heard this is not a good idea unless for a really small and simple estate. The friend/relative is going to have to hire professionals to handle most of it anyways. Better to negotiate a low rate and appoint a professional. If no rate is specified they can claim a max of 3.5% of the estate as fees.
