A few more examples in my friends case of men being screwed.
He was married out of community of property.
She still ended up with half his stuff even though as per prenup she should have not. Litigate to death until she got what she wanted. If role was reversed court wouldn't entertain it.
He is denied his visitation rights but when he goes as far, after multiple court cases over the same issue of visitation which he won, to get the police involved as she is in violation of a court order.
So that he can see his child what does she do, she lays a complaint against the police officers - bringing firearms into vicinity of the child even though they were holstered. Kicked up such a fuss.
Now guess what even if he phones the police they refuse to go to her house. Reverse this situation and cops would lock him up without blinking an eye.
Another one keeping the figures rounded for ease of math/understanding this obviously differs on case to case basis.
Ex works and thus is not entitled to maintenance this is for child only
Lets say school fees at public school is R1000pm
After school care is R1000pm
Medical Aid is R800pm
Room/Board R1000pm
Now a child does not need new clothes every single month. This also differs on age of child but lets say quite young then every season (Winter/Summer) they would need new clothes. R3000 per season thus R6000 for the year divided by 12 = R500pm for clothes
Probably missing a few extra expenses but this totals R4300pm (so before
@Emjay has a fit lets make it R6000pm for some of the other stuff I have missed)
The child needs R6000 pm. Now lets say dad Earns R60k pm and mom R40kpm
In my books the father needs to pay R3600 and mother needs to pay R2400 that is fair.
In most cases what does the court do they grant the mother R10k in line with the fathers earning and not what the child needs, thus what does she pay, what is her portion? This is purely for the child so WTF is the rest used for....for herself not the child.
