Message received from CCMA

cleaning services are expensive, and you really have no idea who you are getting, or whether you will get the same person etc?

What is a 'decent' family?

I don't have experience with CCMA but I guess just follow through with CCMA and explain she has only worked for you for less than 3 months and also didn't pitch up for work over December. Give notice and Get rid of her and pay whatever they say you must pay, which properly won't be much as she only worked for a short time for you. Using cleaning service for a month or two.

Now when you get someone else, read up on the law regarding domestic workers, your rights and their rights.

1. Get a contract.
2. Stick to the contract and be strict on the times. No favours and half days Fridays. No extras. Nothing that is not stipulated in the contract.

No matter how nice you think you are, someone who are desperate for money is not gonna be so nice the day they don't get what they want.

Besides being 'expensive', there really are no cons. I pay R180 a day, 7:30 to 14:30. Always the same lady, well trained, if I don't like her anymore they send someone else. If she is sick, they send someone else. If I go on holiday, I don't pay. I don't pay any extras, transport or food. I do give her something at Christmas time extra. Other than that, nothing. I'd she has a problem she can talk to her company and vice versa. Everyone is happy.

sweep south?

had any crime since using them?

Hire Malawians. They work harder, are far less likely to steal, don't have the entitled mindset of our local alternatives, no contract required. Win.

So it only became a problem when you found out you were paying above market rates?

It is difficult finding decent workers. Rather pay above market rates for a trusted and known person than pay market rates and not know what you are getting.

What would you do if your manager gave you 10 days notice after he found out he was paying you above market rates? (and started looking for minor reasons to dismiss you?)

The message from the CCMA is correct, you just told her not to come without giving her a reason or severance pay. This is someone's mother and family member.

Where do you think she would find employment with 10 days notice (after working 8 years for the previous owner) and how would she survive without severance pay?

Rather call her back, apologise for being silly and re-hire her. Pay a premium for a trusted employee or take the risk of hiring an unknown. Plus you will save on the CCMA penalty (which you deserve for treating her shabbily).

Thank for the reply,
When we say month salary
Will that be previous owners salary X
Or which i paid Y?
How long did she work for you?
Less than 3 months?
If so then surely it's not the same as someone working for you for say 5 years.

You tried her services and decided against it.

But at the same time good luck with finding a replacement at min wage.

Basic conditions of employment applies. Familiarise yourself. Unfortunately you will have to pay school fees either by coming to an agreement with the domestic worker or at the CCMA - I would suggest the former especially since you have basically flouted the BCEA and UIA.

A sensible post. However, it will be lost on a few, and most certainly the OP.

Thank you for your reply,
Could you please advise tentatively how much could I end up paying...
