It is one of the reason and the main reason she is working on her own without timings. Some of the work she didn't do and we ended up doing our selves.

It is difficult finding decent workers. Rather pay above market rates for a trusted and known person than pay market rates and not know what you are getting.
Agree and at the same time it is difficult to get the work done here as she didn't fulfill her job.

What would you do if your manager gave you 10 days notice after he found out he was paying you above market rates? (and started looking for minor reasons to dismiss you?)
If I am not mistaken,
1. First 6 months probation period and can be accepted.
2. Always better to listen the reasons.
Nevertheless, I would always prefer to chat first and if they won't agree then I will reach.


The message from the CCMA is correct, you just told her not to come without giving her a reason or severance pay. This is someone's mother and family member.
Informed 10 days before which is a notice. Yes and I do have a lot of respect.

Where do you think she would find employment with 10 days notice (after working 8 years for the previous owner) and how would she survive without severance pay?
She worked for me a period of 3 months and 10 days is as per norms.. I understand but the severance pay she could have already received from the previous owner and I don't know what she would have done if I don't hire her 3 months ago.?

Rather call her back, apologise for being silly and re-hire her. Pay a premium for a trusted employee or take the risk of hiring an unknown. Plus you will save on the CCMA penalty (which you deserve for treating her shabbily).
 
Besides being 'expensive', there really are no cons. I pay R180 a day, 7:30 to 14:30. Always the same lady, well trained, if I don't like her anymore they send someone else. If she is sick, they send someone else. If I go on holiday, I don't pay. I don't pay any extras, transport or food. I do give her something at Christmas time extra. Other than that, nothing. I'd she has a problem she can talk to her company and vice versa. Everyone is happy.

I assume this is in Gauteng? Is there a similar service in Cape Town maybe?
 
Tear the notice up and forget about it. My kid got awarded R120K in a CCMA case, went through all the channels, to date, NADA, Even though payment date bY CCMA was FEB 2016.
 
And we realized a month later that we paying way more than market related and the heard previous owner of the property did paid the market related. And we did even warned about the timings as she don't even work 7 hours a day including a lunch break but she didn't care and she does the work on her own. Half days on Fridays. So we informed her 10 days before don't come after the 31.Jan.
What were you paying her per day?

Were you making the appropriate UIF contributions?
 
OP, I seriously doubt she would have lasted 8 years with the previous owner if she was an underperforming or problematic employee (that you are now portraying her to be, yet you initially alluded to dismissing her after finding out you were paying her above market rates)

If her work was really the problem then you would have made that the crux of your original post.

It is difficult to understand how you consider yourself "decent" given the facts that we have before us. You need to realize that you are not the victim here, the domestic worker is.

Did you register her for UIF? If not, your problem just got a lot worse.

I did paid monthly but there is no agreement so unfortunately, No UIF contributions.

So you essentially hired a domestic, and paid her happily for a few months until you realized it was higher than "market related". What is "market related"? It is probably a range of R150 to R400 per day? She was a salaried employee of yours, and you just dismissed her.

Did you not discuss this with her? Say that her rate is more than you can afford (if that is really the case)?

What were you paying her per day, or month? In rand terms? R250 per day, R300 per day, more?

Agreed, also market related is abs SH!@ there is a reason we call the lady that helps us a domestic goddess. I wouldn't dream of paying her that little. The house, clothing, furniture is kept in immaculate condition and she deserves commensurate remuneration...

This whole mentality of paying someone the minimum wage is ridiculous, why do you get paid that! If we are privileged enough to hire someone provide employment etc the minimum from our side is just not cool.

Maybe you should just not have anyone...

On that note Ill leave this, as it appears that that's the route you are going you let someone go because you realised that you paid more than the "market"
