I did paid monthly but there is no agreement so unfortunately, No UIF contributions.
Lets try again - What were you paying her per day?
 
The CCMA will try to get you both to agree on a fair settlement amount at arbitration, just pay that and move on.

Be fair if you need to back pay UIF (which you should be doing) then do so.

It's actually your fault for not having a written agreement and offering a wage you were happy with so consider it school fees.

Terminology will get you. You can't just "dismiss" someone for no reason.
 
OP, I seriously doubt she would have lasted 8 years with the previous owner if she was an underperforming or problematic employee (that you are now portraying her to be, yet you initially alluded to dismissing her after finding out you were paying her above market rates)

If her work was really the problem then you would have made that the crux of your original post.

It is difficult to understand how you consider yourself "decent" given the facts that we have before us. You need to realize that you are not the victim here, the domestic worker is.

Did you register her for UIF? If not, your problem just got a lot worse.

My in laws have had their help for 20 odd years. She is one of the laziest domestic's that i've ever come across but they can't/won't fire her because they know she'll take them to the cleaners.

They've figured it's now easier for them to move to a smaller house (moving from Alberton to Centurion) with no domestics quarters and tell her that they're happy to keep her on but she needs to find her own accomodation in the hope that she won't follow.

Back to OP, he made it clear his main reason for dismissing her was finding out he was paying her a higher rate.



Surely he would have asked the previous owners about her work ethics, her daily rate etc.

OP realises he is in a corner and looking to cover his real reason (which he inadvertently admitted in the OP).

What is OP stands for?
As you said I could have done finding the right wage before confirming and could have done the agreement. I have noted that and will do it next if I hire anyone again.
But from my side, I just had her for 3 months and I am asking advise how to reduce the damage what was happened.
