Rubbish. Then they'd lose all their customers. Stop being so overly-dramatic. They want as many happy, contented customers as they can get.

I'm sorry but why should one have to do that?

MWEB should either shape all encrypted traffic OR they should allow use of it as much as non-encrypted traffic.

I am sure MWEB would prefer more people who do a max of 10-20GB pm on their uncapped accounts.

ASASA is not a copyright enforcement body. They are an advertising standards body. If they allow that to detract them they are a failure.

I don't believe that the relevant T&Cs are legal or enforceable, which is why I want to see them tested by the relevant legal authorities. That said, the T&Cs are so broad that, taking them at face value, it's likely that nobody hasn't violated them in some way.

You can go dig through the old 'MWEB Q&A' thread pages from back in March (?). The shaped product as described and promoted (read advertised) there is a far cry from the product we have been forced to (and continue to) endure.

So basically, go make use of a spade.

And degrade the performance of the network as more and more users pull hundreds of GB monthly at line speed? Then when you can't browse the web or download your email, you'll be the first to complain again.

LINE SPEED. Isn't this an UNCAPPED OFFERING? Aren't we paying extra for that line speed to TELKOM too?

Advertise it as UNCAPPED OFFERING AT 65KB/sec for only a maxium of 2-3 hours per day.

Whether or not somebody who brings a case before ASASA/ISPA is a pirate would not be relevant I imagine. At least in the cases currently proposed against MWEB.

Thats my point - I could be wrong, but I think it would be illegal for MWEB to monitor exactly what you do.

Yeah, and they know that people won't be willing to pay them all that dosh knowing that they've taken a stand against 'piracy'.
 
They'll phone you and tell you when you've abused the system... only problem is - its a one time call to say cheers.
