This has been tested in the constitutional court and the decision was that indeed they're not included. The test was about a coloured chap being fired from Eskom because, as the media put it, he was not black enough. The point I'm stressing here is not that we are being excluded, but that the constitution is protecting the discrimination under the guise of fair vs unfair discrimination. Discrimination should be just that - discrimination, and no distinction should (and in effect IMO logically) be made. It is grammatically a nonsensical statement and actually flaws the constitution. I certainly wish that the race problems we're currently experiencing would go away, but the reality is as long as it's protected by the constitution, and the ruling party maintains that protection, racial issues are here to stay.stoke said:The constitution defines Blacks as including other races except for white.
