This is from people I know working at the SAPS main building in Pretoria.

I've discovered the problem. This email is so badly paraphrased that its bound to cause a lot of confusion. For example:

Fitness of drivers
Driver not licensed R 1 250 4

Should actually read:

Employed or permitted another person to drive such
vehicle while the said driver did not have driving licence to drive
such vehicle

The points you loose should be linked to your insurance premium - the more points you loose the higher your insurance premium. This in my opinion will get most people (who have insurance) to obey the traffic laws. As mentioned earlier - these new laws mean nothing unless enforced. SA actually has great laws and by-laws but zero to none effective enforcement. I wouldn't worry too much about these new laws.

I dont think it will work unless insurance becomes mandatory (as well as an annual MOT type vehicle exam).

Actually i am curious to know if anyone knows about speed cameras near roadworks. I heard a rumour that it is actually illegal. Is this true?

I'm not completely certain - but I think that police need a license from the NPA to operate a camera. I'd also assume that they have to put a camera sign up if they were going to use one.

WTF? so i am smoking in my car as most smokers do, come to a roadblock, and they want to breathalise me, so i lose 4 points and get a R1250 fine ??
Completely flipping mental.

Nothing more than a new money making racket dreamed up to suck the last vestiges of money from the man in the street.
Someone should encourage and start a campaign to ensure all drivers fight every fine received in court, bog them down with so much wasted time and effort that they eventually scrap this stupid con.

Once again, I'll repeat that this email was paraphrased and is ambiguous. The actual clause is:

Whilst being detained for an alleged contravention of any
provision of Section 65 of Act 93 of 1996, during his or
her detention smoked before the specimen was taken

That being:

Operated a vehicle while under the influence of
intoxicating liquor or a drug having a narcotic effect

Occupied the driver's seat whilst the engine was running
and whilst under the influence of intoxicating liquor or a
drug having a narcotic effect

Read the actual chargebook and not this sensationalist mumbo-jumbo that has everyone on edge.

No the pilot phase is underway in JHB too.

"AARTO entered into force on a pilot basis in the municipal area of Tshwane on 16 July 2008. The pilot implementation has been extended and AARTO is operational in the municipal area of Johannesburg too"

As stated previously demerit points are not issued during the pilot phase which is currently underway.

They are still enforcing the laws and traffic fines though.

You don't lose points, you acquire points. You start out with 0 and once you reach 12 points your licence is suspended for 3 months..
