Yes, the buyer pays for the levy clearance certificate but the attorney must pay for his own runners.

Here in Cape Town we don't use any runners as everything is done online, no need for them.

It is actually a very strange concept to me.

I heard down under in capetown its now law to install prepaid meters! Lol

Guess things are diff up north
 
This seems very strange to me. As shown in my invoice from our attorneys a few posts back, we're definitely not paying anything for the rates and levies clearance certificates. This was also stated in our OTP.

Also what agents fee is the buyer liable for?

I see that now, that is quite strange. A Rates Clearance for the City of Cape Town is just over R500 currently.
 
Yes, all new houses must have prepaid, it works perfectly for us as it is easier to track your use.

A friend of mine bought off plan, getting the keys tomorrow. What a mega surprise, prepaid with smart meters. Admin topup is 10%, meter reading (which is digital, R25 per meter).

Lol. Thats why I say, all fees upfront please. Now a bit too late for buying regrets

You got ripped off, honestly. All clearance related to confirm all is good on the sellers side. Thats what I am saying, I never paid 1c ever. But its clearly how you do/understand (and protects yourself).

See it this way, I will gladly pay for the certificate if its in my name (to confirm my bills are up to date). If any attorney can show I am the title holder of the account (as a buyer).....
 
Another question (Sorry if its a stupid one)

My bank appointed the same bond attorneys that was also doing the transfer.
I got 2 separate invoices and both include "Deeds Office Fee" and "Deeds office search fee".

Am I paying twice for the same thing? Or is it completely independent?

The transport leg and bond leg are 2 different things. If its the same guys, ask for discount

We have the same. Same attorneys are doing our bond registration and transfer. Bond and transfer both need their own Deeds Office Search Fee as I understand it.

We got a discount on both invoices on the attorney fees. Not on any of the other lines.
 
Picked up a few more boxes from people who just moved in a few blocks away.

Their sale is still not finalised after 6 months.
Some problem with the rates and taxes clearance. Delay at City of Tshwane according to the wife.

So they moved in on Tuesday and will be paying occupational rent until further notice.

Here is hoping ours do not take as long. Will check weekly progress report later when the attorneys send it.

Yes, that is normal. Remember that these are not fees that the attorney charges, these are disbursements against the account. These HOA's charge exorbitant fees to issue a clearance.

And it is part of the costs that the buyer contractually agrees to pay.

WRT to the double Deeds Office Search fee: If it is the same firm then they should only charge you that once, this is also applicable to the FICA fee.
 
Update time.

Okay so the old people are buying in the retirement village where they are moving and the same attorneys have been appointed to attend their purchase there as well.

Not much new detail other than that available in our weekly progress report.

This will probably be causing some delay in our purchase and moving date. Not sure to what extent. Will discuss it with the relevant parties when we get in contact next week again.
 
Any updates on how long it took to get rates figures in Joburg recently? Waiting on that primarily now
 
So all documents are drafted and we are signing transfer documents on Monday.

Attorney reckons if all goes well with no other delays we are looking at transfer and registration to be done by mid October.

Our Transfer Fees invoice is coming on Monday. So want to be prepared.
