OpenWeb ADSL Feedback Thread (Pt2)

I wouldn't hold my breath. They both know they've been busted, hence their silence. However they seem to have some fanboys here, one of my posts about OW got censored I see...

I just wish they would come out and say something. There's clearly an issue on the network somewhere. I've never had a well-seeded torrent download so slowly in the two years I've had the account.
 
Such correspondence are not uncommon. If you send too many emails complaining about the service you'll often be met with a veiled threat asking if you would like your account cancelled. I've seen that one on more than a few occasions.
Ja the South African way of doing business. The truth is a painful thing for service providers to deal with.
Its very rich though that they say MWEB throttles. They don't, and the only reason I left them was I was not interested in the whole abuse cap business. Until the day I left them I had stable internet, especially during the day, it was shaped, but shaping means it still works, even torrents worked during the day. I wish he would actually just cancel my account.

I would say this is a cowardly thing to do but I am not in the mood for the backlash.
 
Yeah I also think something is up on the network. I don't use the account usually during business hours but the few times I have, things have not been bad. Yeah downloads were shaped but streaming and browsing were fine.

At the moment though, it seems like everything is borked.
 
I cancelled yesterday - got the end of June BLAH BLAH BLAH rubbish email from them, but I'm seriously thinking of just stopping the debit order from going through on the 1st next month, and if they want to make an issue about it, I dispute the debit order on the grounds that i am not getting what I pay for.

Any lawyers here that can comment on my plan of action ? Will I get into trouble for cancelling the debit order myself instead of OW ?

I am in the same boat as you in that I also have to put up with this rubbish until the end of June.

I am not an attorney, but by signing up with OW we agreed to their terms and conditions, one of which is a 1 calendar notice period if paying by debit order and I think we will probably find somewhere in the 'small print' that OW has covered their own a**es regarding the bad/non-existent service.

So I am not sure that you/we will have any legal grounds to stop the DO going through at the end of the month

I would also like to know the opinion of any legal minded members on this forum.

Hypothetically, here is how you can get rid of an "Open"web account by stopping your debit order after sending a cancellation request by adhering to their own T&C's (but you would need to interrogate this *yourself* and make an informed decision *yourself*, YMMV and I take no responsibility for anything but a hypothetical post :D)

Their T&C's:

8.1 one (1) calendar months’ notice for all Users making use of debit/credit order payment facilities,
given before the 25th day of the month before the last month for the provision of the Service (e.g. if
the User wishes the Service to terminate at the end of April, notice of termination must be given
before 25 March). Users may not downgrade their ADSL account/s during the one (1) calendar
months’ notice period. Where proper notice is given in time, OpenISP CC will issue, by email, a
cancellation reference number. Only once a cancellation reference number has been issued will the
User’s account be deemed to be cancelled.


Now, taking note of the bold above, notice that when you send an email to '[email protected]' you will immediately receive an automated response containing a (copied and pasted directly from the email I received):

Your cancellations reference number is: (#xxxxxx)

Thus they have a) issued this from an Openweb email address and b) provided a cancellation reference number

So by using their T&C's I am assuming you can stop the debit order after sending a cancellation email to the '[email protected]' AND receiving the automated cancellation reference number.

Openweb - Something you should look at, or move away from calendar month's notice, up to you :)

This happened to me too. I was asked if I thought their legal department would find my emails funny? Bizarre company that.
 
After two years of up and down service from Openweb, I have now canceled my Gold Uncapped Unshaped product.
The rude and down right demeaning responses to e-mails and the fort knox gate keeper Zelda is something i don't have time to deal with anymore.

A warning to all. It doesn't matter how much evidence you may provide to Openweb, when something goes wrong with your account, the fault is always on your end.

Good bye, and good riddance.
 
This happened to me too. I was asked if I thought their legal department would find my emails funny? Bizarre company that.

In one e-mail I received from them I was told that I couldn't expect to get a Ferrari if I paid for a VW Golf.

The problem I have with that response is that their advert promises a Ferrari at VW Golf prices: confused:
 
Cant fault this Gold Trial account. Its been humming except over lunch when I was out. Max line / exchange speed is 4096k

Streaming on youtube at 1080p without buffering on a 2MB account. Impossibru!

*edit* okay, now its starting to buffer. Still handling 720p like a boss!!
