Ja, the first debit was for June, the second was for July. I don't see the problem here. You were provided with service for June... for which you paid. You didn't pay for July... and this is why you were cut off (on the 3rd... giving you three more free days of internet by the way... for which have not yet paid).

That is how I understand it as well.

Surely the email that you received would have shown the month for which you were being billed? I think you are mixing the months up.

I would eat you both up in a court room, and i dont even know the law ... :p

I can't speak for Gary, but I am soon to be a lawyer. I look forward to meeting you one day in court - if you argue all your cases like you have this one ;)

lol. now you are delusional.

first you ascuse me of not reading mails properly, that its all in the mails. then you move to the fact that i probly signed up after the email was sent so its my responsibility to check for things that i dont even know exist.

Where did I accuse you of not reading the e-mails probably? Please quote it? I asked if you had received them.

so now you have switched to Axxess... a company which has exactly the same terms... Payment in advance.

Yeah, and Garyvdh says consumers must stick together...

....right!!!

This is about substance vs form. In my book, form never, ever, trumps substance.

Openweb themselves will realise they have lost a client and a lot of goodwill over this.

If I was Mr Beep, I know how I would respond...

So I expect you will be filing papers then soon to get your money back from OpenWeb?

I sincerely hope that is not the case. It simply is not warranted.

hehe... four years of law school served me well :D

OK, that's not the greatest of invoice emails.
Did you stop account use before July? Otherwise you must have known you would be paying for 2 months (june and july).

Actually, I fully expect Mr. Beep will show up an offer some kind of deal... he always does go the extra mile. In the last thread he offered a free month's access to a different user who then stupidly rejected the offer. But the fact that he is gracious has nothing to do with the merits of this case.

The simple fact of law applies here... as I said earlier... CAVEAT EMPTOR

http://en.wikipedia.org/wiki/Caveat_emptor

Let the buyer do his own homework.

Simple.

lol.

soon to be lawyer, to answer your question.

No i will not be pursueing the matter, i never intended too. I merely wanted to make other people aware before someone else got scammed. I also wanted to point out the poor service anyone would be recieving if they ever got involved with openweb.

but lets come back to the law for a sec.

lets say that i borrow my car to someone, they get a fine with it. the fine gets sent to me because i am the owner. lets say for some reason i dont recieved the fines, i might have moved or i give them to the guy and he never pays.

it goes to court. the law then either fines me a lump sum or i get sent to jail or get given probation.

right.

so here we have the law, the law clearly within its right took the course of action allowed via the proper procedures and dished out the penalty.

But at the end of the day you still jailed an innocent man. no matter how you look at it, an innocent man was jailed.

tell me where is the justice in that ?

Hey Friends,

This was one of the more painfull threads to read.

As someone whom from day 1 always placed the customer first, it truly is not a good feeling to know that one of your clients feel this way about your company.

We have always been honest and direct about our calendar month billing, and always ask the client towards month ed whether they would like to take an account immediately or have it scheduled for the 1st of a month.

We have also placed in in our Terms of Service, which all clients have to agree to before they receive access.

I quote:

4.13 Payment of your account is due on the 27th of each month, paid in advance for the following months access. Accounts purchased within a month, will only last until the end of the month it was purchased in.

This morning, Paul offered the client the account for the rest of July for R649. I authorised this as I would've liked to see the client get some value for his money. This is a discount of R650.

I am really sorry for the inconvenience, but we are bound by our suppliers Terms.

Kind regards
MrBEEP

Good response IMHO.

Stick together hey gary, they charged this oke 1.3k for 3 days use, what does it matter how much he downloaded? They should have over the phone told him you know if you sign now we will charge you 1.3k for 3 days and then 1.3k for the month of july? Why not take this 2gb int account for now and then we will activate your uncapped on the 1st of july. Now that is customer service gary, something you so fiercely fight for. Surely openweb must know they get clients who do not understand how they work, they must also know that nobody in their right mind is going to blow 1.3k for 3 days of internet. To me openweb have failed this person very badly.

Yikes that must be really bad man, 1.3k for 3 days of internet. You got taken badly if you ask me.

you offered that to me after the hell i went through the last week and when i called to cancel my service. did you seriously think i would take the offer. I had already signed up with axxess. you had the chance to make a offer long before that.

on top of that, R649 is half a months payment for 3 days access ? So i must pay more money to have more poor service ?

Why not explain why i could never reach you guys via telephone, you number is allways engaged, why do half my emails never recieve replies, and the others take most of the day to get any attention.

Why did i recieve a cutt off notice 2 hours after my service was discontinued.

these are reasons i did not take your offer this morning. I am not willing to risk my web server running with your company controlling the string that keeps it online.

what you could have done since i was clearly unhappy with openweb was offer me a refund. but no you did not.
