BayTSP, Inc. ("BayTSP") swears under penalty of perjury that Lionsgate Films has authorized BayTSP to act as its non-exclusive agent for copyright infringement notification. BayTSP's search of the protocol listed below has detected infringements of Lionsgate Films copyright interests on your IP addresses as detailed in the attached report.

BayTSP has reasonable good faith belief that Lionsgate Films, its agents, or the law does not authorize use of the material in the manner complained of in the attached report. That is the problem with torrents. You can't just download illegal content, you have to upload it too. Uploading implies the distribution of copyrighted material.

It's the copyright infringment equivalent of being a drug dealer, rather than being a mere junkie.
 
Haha! I reckon it would be quite fun if you lived in Uganda or one of the seriously dangerous countries. I'd make a whole lot of pirated movies available and when they mail me and tell me they're going to get me I'll tell them to fly over and try... Hahaha! Imagine one of those dolly American lawyer's faces when she reads that...

"Uhm, I think there was some mistake... This person couldn't possibly be pirating movies!"

Ok, so its not ok to DL a torrent of a TV series...why is it that we are allowed to tape episodes of the same series on TV ?

It's fine to record tv shows and use them for private use only, and not to distribute them. Same goes for any other copyrighted material. If you could only download these torrents without uploading them, under SA law, you would be able to do so without any fears of retribution. But seeing as you are uploading (ie distributing) you are breaking the law and could be held liable.

Ok...my question above was hypothetical.....

So here is another.

What If i downloaded an episode....or even a movie.....not from these torrents or such where I posibly have to upload or something....but from some random website...? Am I still liabale for an infringement, or is it the website in question, as they have provided the episode for download.

Illegal content on websites are generally "posted" by users, and such websites disclaim responsibilty for the content, except that if they are made aware of illegal content they will remove it. The person postmg the content, if identified, could be liable.

You are standing on much better ground if you only download, not upload. That makes content from news servers and web-based file sharing sites like Rapidshare safer than torrents or p2p apps like Limewire. Of course, if you upload illegal content to news servers and web servers you are putting yourself in the same rocky boat.

"Copying" for personal use can be defended. Soon as you become a "distributer", however, your defence crumbles.

Totally OT but I had to have a good chuckle at this statement. I know one country seriously more dangerous than Uganda ... SA!
 
Why use torrents?

Why does everybody use torrents? Its so much easier to get a rapidshare account and then get the rapidshare links for what you want to download. There are lots of good sites out there providing all the links and rapidshare is so cheap, on £6 per month.
