Petition started to remove judge over rape comments

Cape Town - A petition has been started calling for the removal of High Court Judge Mabel Jansen over comments on Facebook regarding black people and rape.

However, the judge says her comments were taken out of context, and that she was referring specifically to the rape cases she has heard.

Well-known activist Gillian Schutte posted excerpts of written exchanges with Jansen on Saturday and Sunday, in which Jansen said, among other comments: “In their culture a woman is there to pleasure them. Period. It is seen as an absolute right and a woman's consent is not required.''

As excerpts of the conversation were shared on social media, comments flooded back reflecting shock that a judge could hold such opinions, and calls for her removal gathered pace.

Some also asked whether her previous cases should be reviewed for potential racist bias...

I would trust the judge before I ever trusted that idiot Gillian Schutte.
 
Agreed, just read that story and it just screams of one of the usual Gillian Schutte "LOOK AT ME AND MY OPINION" pieces.. I wish she would just shut the fsck up and leave the normal people alone.
 
She has probably heard that justification more than once in dealing with such cases as a judge. Given the disgusting amount of rape in this country, she isn't incorrect...
 
that petition is premature and unnecessary at this point, the judge and her superiors should take charge since the judge's honour has now been called into question. let them be given space to follow due process in dealing with the matter.
 
Mabel Jansen didn't say "In my experience...", she said, "In their culture...", and used reference to her case files to try justify it. On the other hand, Gillian Schutte has violated Facebook privacy policy regarding private messages and that kind of behaviour can lead to a ban. She has demonstrated to be an untrustworthy person with anything said confidentially, no matter how good her intentions were.

I mostly agree with your sentiments, however, a potentially racially bias judge is a matter of public interest. So, it is the duty of ALL justice loving people to shine light on these cases.

You wouldn't be saying that is it was a minister accused of corruption. ;)
 
Having read ALL of the judge's supposed comments, they don't look at all good (if it is true that she actually said that).
I don't see how they can be explained away by just saying "I was referring to the cases I have dealt with".

But having said that... I still don't trust Gillian Schutte.

And you have just painted the whole of MyBB as a hive mind with one opinion on the matter. Plenty of people have epressed distaste for what she wrote but don't let that get in the way of your broad brush...

She had already reported it to JSC and followed up on it too. She could also have reported it to HRC. What was the purpose of posting private messages publically on social media?
