The JSC Code of Judicial Conduct also notes that judges should strive to be aware of and understand the many differences between persons and to remain informed about the changes social attitudes and values. “The multi-cultural nature of African society calls for special sensitivity for the perceptions and sensibilities of all who are affected by court proceedings‚”

How is that irrelevant, if you are truly about justice it should be about all land stolen going back 2000 years, yet someohow only theft by whites is worthy of restitution. How far back do you go in terms of restorative justice and why is there a cut off? Do you agree with the current cut-off of 1913?

You could, but then it will still face the same questions raised when rape is claimed as a general black culture

Generalizations when it comes to race and culture are very easy to make but narrowing it down to the specific aspects is more difficult given that culture is just the way that we are programmed and will vary even across very close ties.

Racism is the most talked about subject but the least analysed especially in the manner it is thrown around.

JUDGE MABEL JANSEN TO APPEAR BEFORE JCC OVER SOCIAL MEDIA COMMENTS

JOHANNESBURG - High Court judge Mabel Jansen will soon be appearing before the Judicial Conduct Committee (JCC). Last year Jansen caused a stir after taking to social media where she expressed her belief that rape was part of black people's culture. Justice Minister Michael Masutha subsequently placed her on special leave.

The JCC will assess the gravity of the complaints made against Jansen's actions and then make recommendations to the Judicial Services Commission (JSC). The JSC’s CP Fourie says that if the panel finds that the grievance warrants impeachment and the commission accepts this finding, then the Chief Justice will have to be brought into the picture.

“The Chief Justice will be requested to appoint a tribunal to hear the matter and hear evidence. They will then come to a finding which will be submitted to the Judicial Services Commission.”

Jansen maintained her comments were taken out of context

That's because people gives racists attention. If we start ignoring them they won't get the attention they obviously seem to crave. What other reason would a person have to say the things some racists say, and they do it on social media for everyone to see. They can't all be stupid. Ignore them and focus on all our countries issues, and we have a lot.
