Polygraph testing only one employee

You should have listened to all of us saying not to do it ...... hell, even a lawyer said not to.
 
It sounds like the polygraph showed them what they didn't want to see.. that she wasn't lying..

This is seems to be a fairly good case of Constructive Dismissal.... and the CCMA will have a field day.
 
Yeah thats not right.

Her boss has proved that he is not a good person to work for. He doesnt have his employees best interests at heart.

We had a TV stolen last year, a brand new TV. It was stolen while one of our newish female employees was in the office. She was the only one in the office. And you know, everyone was more concerned that she was in the office alone with criminals, than the fact the TV was gone. I never heard a single word of someone saying but she was here alone, it must have been her. The police were called, obviously. I think the point is that, the police would do their investigation, knowing that she was the only one here. If they had reason to suspect her, beyond the mere fact that she happened to be here at the time, they would have done something. But they didnt. Evidently, the facts did not add up, and there was never any suspicion levelled at her.

Thats the right way of doing things. Let the police do the investigation. If they want to question or polygraph an employee, they will do so. And they will provide reasons for why they think it is necessary.
 
If detective work prove that it was not the OP's girlfriend who did the dirty, then she can (and must) sue for defamation of character etc.

I was also in the same situation a long while ago. Laptop vanished from the Bossly Unit's office. Only three of us was in the office.

Got threatened with polygraph tests. Luckily it never happened. I think the cops found out who did it.

Agree

Polygraph can only be used as part of the evidence, not the only evidence but sounded like there was intention to dismiss her from the beginning so CCMA would anyway find against the employer regardless of her guilt.
 
They locked her up, just came from the police station. Got a lawyer involved, borrowed money to pay for him. They threatening her at the police station, saying she must just admit then all will be dropped. She refuse to, she said in tears to me that she feels like just saying it was her to get over this. I told her not do to something so stupid. Shes now there for purgery, as her first statement did not match up with the second one. Something about going into the kitchen before going downstairs. I cant believe this. I hate this world and all the police.

She must not say a single word to anyone without her lawyer present. Not a word.
 
Lay charges against the police and her boss

Go straight to the CCMA as well...

This boss sounds like a piece of work and needs to be knocked down a level or 90.

What is the charge? Theft or perjury or both?

Were both of her statements done under oath or written on an affidavit? If not, tell them to get stuffed.

I know it's hard, but ask her to write down everything that has happened. Where, when and how she was arrested, the arresting officer's name. Was she read her rights/informed of the charge "aka Miranda rights"?

She has 48 hours to appear in court. It being a Thursday (and a sneaky tactic), she will probably only appear on Monday.

Speak to the station commander about getting police bail (depending on the offence) else ask for the name and number of the prosecutor having jurisdiction to get bail. Hopefully on Monday the magistrate will just confirm the conditions of the bail already granted (but your lawyer will prepare you for that).

They're likely trying to intimidate a confession out of her: because they have no ground to stand on.

Don't let her say a word without her lawyer.

If she is innocent, she must maintain her innocence. Don't let her get bullied by these morons.
 
Depending on the circumstances, she can consider laying a counter-charge of crimen injuria i.e. if the charge was laid purely to intimidate her as Lycanthrope says, or is otherwise vexatious or malicious.

OP, I'd like to know why they're only suspecting her??? Surely, as you say, there were other people as well
 
A trusted long term employee probably did the deed and has fingered her.
 
So sorry to hear man. I know it's a catch22 but I wouldn't have done the polygraph. It is a complete bull**** test and because the guys who do them charge so damn much they feel obligated to give results even when the tests are inconclusive.

She did the test, they asked her the same questions over and over again. they repeated it about 6 times, kept on saying shes hiding something

Last year we had a very similar situation. One of my very good friends, who is a nervous fellow to begin with, was tested with 3 other employees. They kept on saying that he is hiding something etc. After the polygraph they were convinced it was him. Couldn't handle it anymore so he quit. 2 months later they found the stolen items in a shop nearby and caught the real thief. Damage was done though.
 
Another thing to add to what everyone has said is she must stay calm. You can do something stupid (out of anger) because you know you are innocent.

I would sue everyone involved.
 
That's hectic and the company and cops are totally abusing their powers to intimidate her. You cannot arrest someone for perjury for a statement not made under oath. Perjury is when you lie under oath.
You need to get that lawyer and have her out of there asap.
 
If you don't know that these tests are complete bs then you're living in the dark ages.

These tests can be faked by literally clinching your anus.

Also, depending on the person giving the test, it can be completely flawed, like if you say, "I'm going to ask you a very personal question" the readings go off the chart before you've even asked the follow up question.

These tests are not scientific, ffs scientologists use it to coax people into the whole dianetics fad.
 
Two years ago we used to (out of boredom during lunch times) play with small IR heli's in the office. One day I left my bag at work, I was using public transport and was just lazy to go back into the office as I was outside having a smoke when I noticed its time to go home.

The next morning my bag was gone, so was everyone's heli's, food and numerous other items. One of the guys had a brand new camera lens stolen from his drawerso he went to the securities to check the CCTV footage (after we've ascertained whom of us were the last to leave the office, so we asked them to play the tapes from there). Low and behold at about 17:50 we saw someone exiting the lift and going through the turnstiles with my fscking bag! The thing was swollen from all the stuff this person packed in!

It was a young lady with serious drug problems. When the HR people confronted her she just confessed and resigned on the spot.

Point I'm trying to make is it was someone NO-ONE of us suspected. We only found out about her problems afterwards. If it wasn't for the camera's we would never have found the culprit.
