Dear Sir

REQUEST FOR NOLLE PROSECQUI CERTIFICATE - STATE V JACOB ZUMA

1. Per your decision not to prosecute Jacob Zuma for fraud, racketeering and tax evasion, kindly issue me certificate Nolle Prosecqui in the above case.

2. Given the alleged conduct of staff employed or previously employed by the NPA, it is of national interest that Zuma and others be prosecuted as permitted in terms of section 38(c) and 38(d) of the Constitution of South Africa.

3. With respect to your decision not to prosecute Jacob Zuma, it is of national interest to apply section 9 of the Constitution of South Africa, many people have been adversely affected by decisions of the NPA and have never been afforded consultation in their matter.

4. In terms of the Criminal Procedures Act section 7(2) of Act 51 1977, you may not refuse to issue a Nolle Prosecqui Certificate given what has been stated above.

5. Kindly acknowledge receipt hereof return of fax to 086 6049311.

If this had been a viable option from the start, they would have done it long ago IMO. A classic case of shutting the gate after the horse has bolted...

You can only institute a private prosecution once the NPA has said it is not going to be prosecuting the matter. That is what the certificate nolle prosequi is all about. So now is the perfect, and only time, to do it.
 
I find it so irksome if people choose to use Latin phrases, but cannot even do so correctly.

It is "nolle prosequi".

Personally I don't care if they are fresh out of law school and are working out of a garage. As long as someone is trying to do something I am a happy man!

Problem is that for it to go ahead, the appelant has to show that they have some kind of intimate connection to and interest in the case at hand. (Like if it was a case of simple theft, then the person who was robbed would have a strong case)

Whether the court will accept that every person in South Africa has this connection when the case concerns the soon to be State president, is debatable.
 
The Zuma threat should've been identified and dealt with years ago (even before being fired as deputy president; long before). He's built up far too much 'momentum' for any mickey mouse action to stop him now. The best chance is that he screws as badly soon after becoming president and then hopefully he can go the way of Mbeki.

Oh ok, makes sense. Although the fact that he is going to be president should be connection enough as he will be presiding over all of SA. But as you say it is debatable...

Would be interesting. I am pretty sure nothing of the sort has ever occurred before in SA.

Well it makes me think... Maybe these guys figured well if the NPA are recieving bribes why not them.

Zuma might just have someone approach them and bribe them before they even get started.

But the beauty of private prosecution is that it is theoretically open to everyone...Although you do have to bear the costs yourself...which would rule out a lot of people already.

That is quite a beautiful thing because, if the party prosecuting has to cover their own costs obviously they would have to be really invested in the case for it not to be a waste.

I assume these guys are trying to make a name for themselves by trying a case even the NPA dropped?
 
so is this actually happening? or more people simply talking about action?
