Problem with Hosting co.

Domain hostage

Hey guys

I am having a similar problem as you guys. The company i am with won't release my domain because they want me to pay four more months hosting. The domain is also in their name. But I have proof of payment. The only problem is that the contract states this

"The duration of this contract is 12 months from date of signature; thereafter I may cancel the request in writing giving thirty days notice. Failure to cancel thirty days prior to expiry of contract will result in the contract being automatically renewed for a further 12 months in the same structure."

According to this contract i still have four more months. My question is can they legally do this.

If it is written in their contract, and you have signed the contract, then they can do that. Just make sure you state in writing that they must cancel your contract. Otherwise you'll end up paying for another 12 months.

I do not think they are allowed to do that if they listed their domain price separately from their hosting price (and better yet as a separate item on the invoice). If this is the case I think that you are entitled to the domain name - legally and no doubt ethically.

If you purchased a hosting package that stated something along the lines of "order 12 months and get a free domain name" (or something along those lines), then I think you will still need to pay them the contract until you get the domain name. I'm no lawyer so I can't be certain though.

This site once belonged to the notorious "Person", none other than Brian Gibello, the proprietor (and some would argue, charlatan) behind the infamous Dot Computers- a cut-price wholesale mail order computer store offering cutting edge computer hardware and software at a fraction of the real cost. WSITGTBTTIPI (When Something Is Too Good To Be True, Then It Probably Is) Brian is currently wanted by South African authorities for various incidents involving fast ones he pulled- customers bought goods from his company but never got what they paid for in the end. A lot of this saga played out on the (sic) MyADSL forum and several of the forum members there were duped out of their hard earned cash by Gibello. In the end this crook simply skipped the country to the USA, whilst still having the audacity to remain on the local forums with full deniability and tall stories about why he had to leave SA, et-cetera and still promising to compensate those whom he owed goods to

Interesting info regarding the person who started this thread... Just shows that you can never trust anyone on the internet.

Very dodgy guy lol, last I heard he was sitting in prison in Boston for CC fraud.:eek:
 
Hmmm... But it's scary though. I mean, you think you can trust someone you meet on a forum and that you can relate to their problems or whatever, just to later find out that they are actually crooks.

Person was actually very well known across the internet in SA once he got caught out.

There were multiple EPIC threads on this forum too spanning lots of pages where he just dug himself into a very very big hole...search for them, they're worth the read. Like Syndyre says, he's now behind bars in the US.
