Problems with Outsurance

Hi guys,

I want to share my experiences with Outsurance, and also ask for some advice on what to do. Hopefully they resolve this, I just think other people need to know about how useless they are.

On August 31st last year, I bumped someone else from behind. Nothing serious. Two cars in front of us, a bakkie was carrying a desk, without tying it down. It fell down, causing people behind it to break. I saw a bit too late, and bumped the lady in front. Not going too fast, practically no visible damage to her car except for a dangling strip of rubber, and my car had a smashed headlight and a slightly bent grill.

Anyway, I am insured with Outsurance, with comprehensive cover, and she with Mutual & Federal, also comprehensive I believe. We both claim from our respective insurers. My car is fixed in about a month, mainly owing to a problem importing a part. Her car is fixed by M&F, who then try to recover her excess from Outsurance. I received two calls from Outsurance last year, both asking me to confirm the details of the accident, which I do. In fact, the first one, I remember, they got all of the details of the accident wrong, such as the date. It would be interesting if I could hear the recording of the call again. Anyway, after those calls, I presumed that they had fixed the other lady's car.

This year, on Tuesday, I get a summons. Its from her apparently, asking for R12000 for me. Interestingly enough, the cost of the panel beaters was R12000 ex VAT, meaning that they are not claiming the VAT from me for whatever reason. Go figure. Naturally, I phoned Outsurance, who advise me that the claim is still pending. Still pending. Lodged in September last year. And it has got to the point that I, personally, have received a summons. My name is on that summons - if Outsurance messes up their legal obligations, muggins here has to pay R12000.

So I phone them over the next few days, the legal representative kinda does nothing, claims that an offer has been made and they are waiting for a response. Didnt think a response would take so long. The offer was made on Friday, still not accepted today. Meanwhile the clock is ticking - I have to file within 10 days if I want to defend the action. The other party phones me today, and it transpires that she had nothing to do with the summons, M&F had to do it because they were getting nowhere with Outsurance. Also, Outsurance told M&F that the claim was delayed because I was not communicating with Outsurance. Right. Maybe they should look for those call recordings?

I phone the legal rep, and ask her to email both of us to explain what happened. Naturally, we get an email full of words but no content. Internal processes etc. Also interestingly, she gets the name of the other legal firm wrong, twice. I thought details were important to law? She wont say sorry, she wont apologize, she wont admit that the fault lies with Outsurance. I ask for a timeline, she says that Outsurance received the documents in October. And that "It is the responsibility of the other party to follow up on the progress of their claim and for settlement." So, in other words, Outsurance had everything they needed since October, but didnt do anything since M&F were not phoning them every day.

So Outsurance sat on it for 3 months and did nothing. Nothing. Not a thing. Tell me it takes that long to resolve a claim, when your own agent says they had everything they needed in October?

Also I say to her that she (or another representative) should phone the other lady to apologize. She says:
Kindly note I have discussed this matter with my team manager , this is an insurance vs insurance company matter so we are currently dealing with the other party attorney YYYYwho is acting on behalf of XXXX. We therefore cannot contact XXXX directly, should she require updates on this matter she would need to correspond with her insurance directly.

Does that make sense to anyone? Nobody who works for Outsurance can phone her to apologize for making her wait 4 months to have her excess returned? I told her that I would forward any emails to the other lady anyway.

So let that be a warning, folks. You pay Outsurance to provide you with liability cover, but when it comes down to it, they will be so sloppy that they offer virtually no protection at all. If they mess up with summons negotiation, and the probability is high that they will, I am on the hook for R12000. Do you think they will reimburse me? Oh no, they will run for the hills. And they wont apologize or actually explain what happened. They refuse to - they are accountable to no one, not even their own customers.
 
Times like this that I thank my lucky stars for kicking this company to the curb and getting a broker..saving a ton of money.

Hope things are sorted soon...it must be a huge worry. Could you be sued if they dont pay?

And yea.. Outsurance won't get a penny ever from me. I don't even want that R400 ***** cake they dangle to get your details...
 
Well the other party has signed and accepted the offer so in theory I am off the hook now.

Still, my brother thinks I am underestimating how serious this was, and thinks I should complain to the Ombudsman. Should I? Is it worth it?

I still want my complaint followed - I want to find out what happened, I want to take responsibility.

Glad to hear that you are off the hook. Now you nail them for an answer. They have this nice adverts on TV, but is it worth anything ? I bet you would say "No", and so would hundreds, maybe thousands, other "customers".

You got a summons in your name directly because Outsurance were useless.. I would take it up with the Ombudsman for sure.
 
Get confirmation that the summons has been withdrawn/cancelled.

As to your query why they cannot contact her directly: once a party has appointed an attorney, the other attorney cannot, in terms of our ethical code, contact their client directly. This is to prevent abuse or misinformation etc etc.
 
Between June 2011 and May 2012 my firm filed 12 actions against Outsurance. The most compelling reason was ignoring third party claims (a person has a car accident caused by an Outsurance insured driver). In all 12 cases, incompetence and lethargy were the sole causes of the action. All 12 were settled, 11 out of court and Outsurance had to pay substantial legal costs. The 12th matter was settled in favour of our client, who had died as a result of the accident and Outsurance simply ignored all correspondence and phone calls. In court, the two Outsurance employees contradicted each other several times and it became a shouting match.

Looking at complaints like this and comments in general they are not painted in a good light at present, this makes me think I should just stick with who I am currently with.
 
Funny, I thought Outsurance bent over backwards for their clients. Guess it's just a case of false advertising.

In all seriousness though. everyone knows they are a terrible insurance provider yet they still use them; this baffles me.

Ancalagon - I'm assuming you've done the right thing, and moved insurance companies?

My current insurance is via broker which then comes from Mutual and federal.

But starting to think staying where I am is a better bet, and I have never had a ounce of problems when putting in a claim.

and like all things price is king, but it may be better as you say stick with the extra R200.00
 
Move to a broker. Seriously, they have more clout. A decent broker will write a lot of business with a single insurance company so if that company screws too many of their clients over the broker will move the entire book to a different insurer meaning a big loss to the insurance company. That is why the good brokers get dedicated call agents within the insurance companies to help them etc. Insuring direct has always resulted in sub standard service from my perspective.

Personally I wouldn’t touch Outsurance with a borrowed barge pole after 2 run-ins I had with them.
The first one was when my daughter's date drove her car and rear-ended a car. I claimed for my damage from Santam with no problems, I then get a call from the owner of the other car that told me that his insurer (Outsurance) advised him that my insurance company must pay for his damage, otherwise he will lose his no claim bonus and I must claim from Santam. After a short 2 worded reply I never anything again.
Then about a year later my daughter (same one) rear-ended a car while driving her boyfriend's car (different one). Boyfriend was insured with Outsurance and he claimed and had his car fixed. A few months later I get a call from a person claiming to be a legal representative for Outsurance, he asked me about the accident and said that he saw that my daughter drove the car, then wanted to know who's my insurance company. I told him Santam but that it was irrelevant. He then told me that I had to claim for the damage to the boyfriend’s car from Santam under the public liability clause. Again a short 2 worded reply sorted that one and I never heard from them again.
And yes, I know that my daughter and boyfriends and cars are a bit of a bad combination.
