Prove that Local bandwidth counts to your cap

icasa has requested this information from telkom - i am following up with icasa to create pressure for a response

Nice Bedik. Very useful and I think on the right tack. Let me send this (and links)to the people at ICASA....I still find it very hard to believe they are not doing this themselves already....
 
A good way of proving bandwidth usage is counting toiwards your capis for gamers using Telkom Internet and local servers to match their Usage stats from the telkom site with those often given by game trackers (eg bf2tracker.com) which record hours played and often from ip addy etc. This will be an independent verification (Thanx Potshot).
Got a call from ICASA and have now sent them this...

Dear sir.
I believe TelkomSA and or Telkom Internet/SAIX are in breach of Government gazette 29141, more specificly section 3.4.
I have an ADSL 384 service powered by Telkom Internet with a 3GB cap.
Telkom Internet provide an online graphing page which displays bandwidth usage. This enables users to keep track of the bandwidth they consume.
Whilst playing internet games on SAIX hosted servers in the 196.4.79.0/24 range (All local to S.africa) I noticed that traffic displayed on the Telkom usage tracking page was coming from my game playing on the local servers.The game uses about 50MB/hour so its very easy to correlate it with the online usage page. Local traffic IS being subject to the cap.
This is in direct violation of section 3.4. TelkomSA/Telkom Internet is also stealing resourses (International bandwidth = Money) from customers who have paid for international bandwidth. Not only that, it has a huge economic impact on the country as a whole in terms of costs to do business.
I believe Telkom SA & Telkom Internet are the same company and responsible for this disregard for the law.
Everyday I play games or move files localy My international bandwidth allocation gets smaller because local traffic IS subject to the cap In violation of Government gazette 29141 section 3.4.

Telkom SA/Telkom Internet should explain the mechanisms they use to ensure local bandwidth usage is NOT subject to the cap.


If there is anything you need clarification on please let me know.

A strange request but I want to give some unofficial help to ICASA in their fight against Telkom and their upcomming meeting.
What I want is PROOF that local bandwidth is going towards your cap...
The most obvious is gamers playing on local only servers getting capped once they hit their cap allocation.
Please if you can provide proof (or ways of getting it) rather than annecdotal evidence. It needs to be sharp enough to bloody the Telkom noses well and truely and give them no room to wriggle out of their need to adhere to Government Gazette No 29141 and article 3.4

I may have misunderstood the question, but why not just download from ftp.saix.net (Use Telkom's SAIX network, just to be safe), request bandwidth usage and use that as evidence?

Seems simple enough to prove to me? :confused:
 
Would it be possible to take Telkom to the small claims court over this?
 
Can I suggest that all forumites who are using Telkom as their ISP send a mail to
[email protected]

Similar to the one I sent seen in post 44 of this thread. As another forumite posted the best evidence (you dont have to do it, just site it as an example) is that you download from ftp.saix.net and the download is reflected in your online usage contrary to section 3.4 of the gazette. Make sure you get an acknowledgement and a case number and dont let up till you do. Good luck!
 
Hi all, just to keep this going Id just like to say that ICASA are doing a good job helping me *gasp* since i chewed some ears off and keeping me informed and up to date with calls and mails. I just recieved a call from someone who was either with Telkom Customer services or from their lawers apologising profusely for not getting back to me sooner (!). She assured me that delays in responding were down to Telkom and not ICASA. I have been assured from the lady who asked if we could talk on first name basis (laywers Im guessing)that I will have an answe from Telkom legal regarding why they think its ok to charge for local bandwidth. You will be the first to know right here....
