Prove that Local bandwidth counts to your cap

A strange request but I want to give some unofficial help to ICASA in their fight against Telkom and their upcomming meeting.
What I want is PROOF that local bandwidth is going towards your cap...
The most obvious is gamers playing on local only servers getting capped once they hit their cap allocation.
Please if you can provide proof (or ways of getting it) rather than annecdotal evidence. It needs to be sharp enough to bloody the Telkom noses well and truely and give them no room to wriggle out of their need to adhere to Government Gazette No 29141 and article 3.4
We can takle the other issues later.

Everyone knows it, but the managers in high positions believe they can just insist that local does not count. If you state your arguments clearly they will just answer another question and insist local does not count.

Instead, we should insist it does count and tell them to stop playing dumb. Remember, people who act like idiots drag you down to their level and beat you with experience.

Thats my 2 cents.

I would like to give you info next month on my TelkomInternet2GB account, but how? How you going to prove it. Telkom has a soft cap.

Maybe dowload lots from ftp.games.saix.net. That's local! Just line it up in your DAP/Flashget this month then make yourself get capped next month and use SASA ADSL Stats Analyser to get the info?

That can be turned against them - they are also an ISP. Their accounts don't exclude local from their caps.
It cant be turned against them because Telkom claims TelkomInternet is a separate company.

In fact they go so far as to say “ISPs, including TelkomInternet, obviously need to comply with the Regulation in this regard."

but exactly - it can be held against 'them' - being TelkomInternet - seperate company or not.

All we would have to do is use TelkomInternet to connect and have everything the way we want it - then maybe ISPA would get into gear and make some little fires @ ICASA.

Then 'them' isnt Telkom it's TelkomInternet.

You might as well go after Webafrica, Openweb, Axxess, and any other ISP that caps because Telkom is claiming that they dont cap local and in a slimy sort of way they dont.

I hear you - but as separate as TelkomInternet claim to be - they are still TelkomInternet.

And if it's ISPs we have to go after; they're my 1st choice as a candidate. What would TelkomInternet's response be to why they count local toward the cap?

Then imagine they're called BobInternet. ;) Everyone knows they're linked but proving it absolutely and getting ICASA to give a toss are two separate things. ICASA has all the tools it needs at its disposal. They just dont want to use them.

I think the first step is to prove this and thats all that is required. Phone your ISP and ask, demand in fact. If SAIX are charging ISP's for local then it blows this whole thing out the water. If not, then ISP's should be sued or something.

Primarily if ISP's are charged for local usage then they are OBLIGED to charge us in turn as it is understandable to make at least some profit on the service.

Buy a local only account - if it expires that would be proof enough right?

The first step is getting ICASA to want to act. Good luck with that.
 
Remember how it used to be. You reached the 3 GB cap and then had a trickle feed except for local bandwidth. Seems to me that the arguement should still hold for proof as to whether local usage contributes towards the cap. If you are capped for whatever reason then there ought to be no slow down whatsoever on local usage otherwise it is contributing to the cap - otehr words, if it doesn't contribute why would it not be at full speed.

Then let Telkom answer that question.

Sorry that I can't help on giving evidence - I don't use enough of the bandwidth to get capped - although it did happen once a long time ago. Silly me didn't take into account that uploading also ate bandwidth.

I am comfortable with the way it works at the moment because of how I use the internet. But I am not saying that I should be the measure for anyone else. So good luck.
 
^^ Oh yes thanks. I get so tied up in this affair with total morons at Tkom and SAIX and ICASA etc I end up moaning at the entire world.

Just a question. If they are a seperate entity somehow, would like to know where SAIX would fall in and if complaints to the FSB and JSE can be made about SAIX??

Also this meeting with ICASA and Telkom must be made more public I think. If we don't get the points across now we never will.

Hoping this thread may change our views of these people at Tkom, ICASA etc if they act in our best Interests after this meeting

Interesting. I like Albereths pont that one should always get local traffic once capped if the gazett article is enforced correctly.
I am worried that Telkom could weasle out of their obligation by saying they are not the ISP. It seems hard not to believe that they are one entity (Telkom and Telkom Internet) after all they advertise all their products on one page.
Maybe the onus should be on Telkom to prove to ICASA that they are not capping or charging ISPs a usage based fee on local bandwidth?
I do think that Telkom Internet should be forced to comply for starters.
