You're welcome to put your head in the sand but equality policies are put in place to stop the the nepotism, cronyism that happened in the past, this is what the judge was implying I think.

That's not to say nepotism/cronyism isn't common place today but the tables are still in our favour in the top positions and it is going to take a while for it to balance out.
 
So at least he admits he isn't good enough to get the job on his own and needs a racist system to help him out..

:D I also admit a racist system helped me out. Ironically in my case, it was White men who applied the transformation agenda, opposed the state of affairs at the time. There were no Transformation targets imposed on institutions but there was a Transformation Principle.

To my knowledge judges are indeed lawyers.
Lawyers being the generic term covering those within the legal profession ie. Attorneys, advocates, senior counsel, prosecutors, magistrates and judges.

Judges need to be appropriately qualified which is taken to be a legal qualification - essentially the LLB or an equivalent thereto.

Lawyer as a term is used to refer to a practitioner or person employed in the practicing before courts and tribunals and who is appropriately qualified.


Legal academics who are non-practitioners aren't lawyers and a professor holding a chair in law tends also not to be thought of as a lawyer even if the professor does engage in mediation or arbitration proceedings. As a rule I would regard calling somebody with an LLD a lawyer an insult - they are a doctor, a real one.

A person who just does mediation might end up being referred to as a lawyer but I don't think the norm is to think of CCMA commissioners as lawyers if they don't (and haven't) practiced "privately".

Several (but not many) judges have been appointed from among legal academics and they are not therefore lawyers on assuming the bench. Also there is a tendency to think of the bench as outside of legal practice and so lawyers and judges thought of differently.

Of course there are other oddities - for example I have no idea what one would term a person with credentials in legal academia (peer-review publication record) without a legal qualification to practice.
